Analysis

This resolution authorizes the Commissioner of Public Works to execute an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of delegating responsibilities for the design and construction for the 43rd Street Ditch Project for the Kinnickinnic River in the 8th Aldermanic District.

Body

Whereas, The Southeastern Wisconsin Regional Planning Commission, in its 2024 Milwaukee County Hazard Mitigation Plan Update, determined that 624 structures in the KK watershed are in the 1% annual probability floodplain with potential direct and indirect flood damage costs estimated at over $66 million; and

Whereas, To reduce the risk of downstream flooding for approximately thirteen structures in the vicinity of South 43rd Street and West Lincoln Avenue, MMSD has determined that improvements to the

ditch and additional floodwater storage are required; and

Whereas, The segment of the ditch between West Lincoln Avenue and North 35th Street is lined with concrete and connects on its north and south ends by underground culverts to convey flow; and

Whereas, MMSD’s implementation of the improvements on this segment of the project will directly impact land, utilities, and structures owned by the City, including but not limited to, the City tow lot, the Lincoln Avenue drop-off center, the Lincoln Avenue sanitation yard, a City-owned waste transfer station, a Milwaukee Water Works (MWW) building and a City-owned storm water treatment pond; and

Whereas, MMSD will contract for the project design with engineering services consultants, including final design, preparation of bid documents, engineering services during construction, and post-construction engineering services for the project, and

Whereas, MMSD will use a public sealed-bid process to contract for the construction of all elements of the project, and will perform all construction inspection and construction management for the project; and

Whereas, MMSD’s responsibilities and the City’s responsibilities are detailed in the Agreement, a copy of which is attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the purposes of delegating responsibilities for the design, bidding and construction oversight of the 43rd Street Ditch project, is approved as attached to this file, or one in substantially the same form and substance as submitted; and, be it

Further Resolved, That the appropriate City officers and employees, including the Commissioner of Public Works, are hereby authorized to sign the Agreement, or one in substantially the same form and substance as submitted, and to undertake such acts as are required of the City thereunder or in furtherance thereof, to effectuate the Agreement and this resolution; and, be it

Further Resolved, That any expenditure of City funds that may be necessary as a result of the City signing the Agreement will be brought forth for Common Council consideration and approval.
