Analysis
This resolution amends A Plan for Milwaukee's Northwest Side: 1987 - 1992 to allow office, auto dealership and sit-down restaurant land uses instead of only office and hotel land uses in the Metro Center General Planned Development, generally located South of Good Hope Road and West of 107th Street.
Body
Whereas, The Metro Center General Planned Development ("the GPD") is located generally South of Good Hope Road and West of 107th Street on Milwaukee's Northwest Side; and
Whereas, Pursuant to Section 66.1001(4)(c), Wisconsin Statutes, "No comprehensive plan that is recommend for adoption or amendment under Paragraph (b) may take effect until the local governmental unit enacts an ordinance that adopts the plan or amendment"; and
Whereas, The Common Council of the City of Milwaukee approved A Plan for Milwaukee's Northwest Side: 1987 - 1992 ("the Plan") on December 8, 1987, which includes the proposed GPD's parcels; and
Whereas, The City's zoning ordinances enacted or amended pursuant to Section 59.96, Wisconsin Statutes, shall be consistent with that local governmental unit's comprehensive plan; and
Whereas, Map Nine on Page 28 of the Plan, titled "Commercial Component," indicates the parcels under consideration be developed as office; and
Whereas, Map Eleven on Page 30 of the Plan, titled "Open Space Component," indicates the parcels under consideration are a Significant Natural Area; and
Whereas, A landscaped buffer provided for in the GPD meets the intent of the Significant Natural Area indicated in the Plan; and
Whereas, Map Thirteen on Page 32 of the Plan, titled "Special Site Development Component," indicates the parcels under consideration are in a Special Site Development Area; and
Whereas, From time to time as conditions change and development opportunities present themselves, the City considers amending its comprehensive plans at the request of developers, landowners and elected officials; and
Whereas, The landowner has stated that the area cannot be developed as only office and hotel land uses under current or foreseeable future market conditions and the market opportunity is for a mix of office, auto dealership and sit-down restaurant land uses; and
Whereas, Pursuant to Section 66.1001, Wisconsin Statutes, the City Plan Commission adopted the Plan amendment and recommended adoption to the Common Council; now, therefore, be it
Resolved, That the Common Council of the City of Milwaukee, approves the amendment of A Plan for Milwaukee's Northwest Side: 1987 - 1992, so that office, auto dealership and sit-down restaurant land uses be allowed instead of only office and hotel land uses in the parcels composing the Metro Center General Planned Development; and, be it
Further Resolved, That the Commissioner of the Department of City Development is authorized and directed to send copies of the Plan amendment to the parties identified in it as having responsibility for implementation of the Plan for their reference and use.
