Resolution authorizing an Intergovernmental Cooperation Agreement with Milwaukee County for realignment of North Granville Road in the vicinity of the Little Menomonee River at 91st Street and to authorize acceptance of a quit claim deed from Milwaukee County to dedicate public right-of-way, in the 5th Aldermanic District.
Analysis
This Resolution authorizes City entry into an Intergovernmental Cooperation Agreement with Milwaukee County concerning realignment of a portion of North Granville Road, and acceptance from the County of a public right-of-way dedication.
Body
Whereas, By adoption of Common Council Resolution File No. 080731 on October 7, 2008, the Common Council of the City of Milwaukee authorized the City of Milwaukee ("City") to enter the October, 2008 City-Wisconsin Department of Transportation ("WISDOT") "State/Municipal Agreement for a Highway Improvement Project" ("City-WISDOT Contract") for removal of a bridge over the Little Menomonee River at North Granville Road, removal of parts of North Granville Road and restoration of the land and river bank after the removal activities, which contract has been executed by both parties; and
 
Whereas, Removal of the bridge structure and its approaches, in their entirety, requires new right-of-way dedication and construction of a re-aligned Granville Road to maintain traffic continuity prior to the removal of the existing infrastructure; and
 
Whereas, Removal of the Granville Road Bridge and its approaches is scheduled for construction in the summer of 2014; and
 
Whereas, Milwaukee County (the "County") owns two parcels that adjoin the bridge and road removal project at 7245 North Granville Road (the "7245 Parcel") and at 7401 North 91st Street (the "7401 Parcel") (collectively "County Parcels") and the bridge and street removal and restoration activities will affect those County Parcels; and
 
Whereas, A portion of the County Parcels is also needed to realign North Granville Road, which portion is legally described as follows and is illustrated in Exhibit A attached hereto:
 
Description of property to be acquired for public street purposes for the realignment of North Granville Road from West Good Hope Road north to a point, in the 5th Aldermanic District of the City of Milwaukee.
 
That part of Lands located in the Southeast ¼ of Section 17, Township 8 North, Range 21 East, described as follows: Commencing at the southeast corner of said ¼ Section; thence South 87°16'00" West, along the south line of said ¼ Section; 27.68 feet to a point in the center line of North Granville Road as originally laid out; thence North 25°20'42" West, along said center line, 938.54 feet to a point; thence North 64°39'18" East 55.00 feet to a point in the present easterly line of North Granville Road; thence North 25°20'42" West, along said present easterly line, 20.00 feet to a point; thence South 64°39'18" West 110.00 feet to a point in the present westerly line of North Granville Road and the point of beginning of the land to be described:  thence North 25°20'42" West, along said present westerly line, 178.62 feet to a point in the easterly line of Oak Hill, a recorded subdivision, in said ¼ Section; thence South 64°39'18" West, along said easterly line, 205.00 feet to a point; thence South 09°44'52" West, along said easterly line and the easterly line of Certified Survey Map No. 7737, 890.85 feet to a point in the north line of West Good Hope Road; thence North 87°16'00" East, along said north line, 81.94 feet to a point lying 80.00 feet southeasterly of, a measured normal to, the easterly of said Certified Survey Map; thence North 09°44'52" East, parallel to said easterly line, 452.58 feet to a point; thence North 35°38'29" East 436.04 feet to the point of beginning.
 
The above described parcel contains 127,782 square feet or 2.9335 acres more or less of land.

Whereas, The Department of Public Works ("DPW"), with assistance from the City Attorney's Office, negotiated with Milwaukee County the proposed Intergovernmental Cooperation Agreement, attached to and made a part of this file, that allows the City to use portions of the County Parcels for construction staging and restoration and that allows the County to dedicate a portion of the County Parcels to the City as right-of-way for realigned North Granville Road as described above and that is to be constructed under the City-WISDOT Contract; and
 
Whereas, The Intergovernmental Cooperation Agreement contemplates that DPW will apply on behalf of the City to vacate unneeded right--way after realigned North Granville Road is constructed; and
 
Whereas, The County is seeking approval from the Milwaukee County Board of the Intergovernmental Cooperation Agreement concurrently with the Common Council's consideration of this agreement; and
 
Whereas, Monies for this project have already been appropriated in DPW's resurface/reconstruct account and the Federal and State Aid Local Bridge Program; and
 
Whereas, The bridge removal and street realignment at North Gransville Road and the Little Memonomee River benefit the City by improving safety through improved traffic design and reducing costs that would be required for bridge repairs if the bridge was not removed; and
 
Whereas, The City Plan Commission has approved acceptance of the dedication of the realigned North Granville Road; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the appropriate officers of the City are hereby authorized to execute the Intergovernmental Cooperation Agreement with Milwaukee County in form and substance of the document that is part of this file, or in form and substance substantially similar thereto; and, be it
 
Further Resolved, That, the City is authorized to accept a Quit Claim Deed from Milwaukee County to dedicate realigned North Granville Road as described above; and, be it
 
Further Resolved, That, City officers and staff, including DPW and the Department of City Development, are authorized to take such further action as may be necessary to carry out the intent and purpose of this Resolution and the Intergovernmental Cooperation Agreement.
