Title

An ordinance amending four air space leases with the Wisconsin Center District in North Vel R. Phillips Avenue, West Wells Street and West Kilbourn Avenue.

Analysis

In accordance with state law, this ordinance amends four existing air space leases with the Wisconsin Center District in the 4th Aldermanic District.

Body                     

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1:  In 2022, in accordance with the provisions of s. 66.0915(4), Wis. Stats., the Common Council of the City of Milwaukee entered into four air space leases with the Wisconsin Center District for terms of 99 years for the purpose of allowing Wisconsin Center District to construct and maintain a skywalk, two building overhangs and a building connector as part of the Baird Center premises at 405 West Kilbourn Avenue and 400 West Wisconsin Avenue, as described in the leases.  The Common Council now finds that as part of the negotiations for an Amended and Restated Services and Benefits Agreement with the Wisconsin Center, it is in the City’s best interest to amend the four air spaces leases to delete all annual payments required under the four air space leases in exchange for the Wisconsin Center District and City agreeing to the new terms in the Amended and Restated Services and Benefits Agreement.

 

Part 2. Attached and made part of Common Council File No. 250211 is a copy of each lease amendment for all four air space leases in substantially the same form as the lease amendments that will be signed.

 

Part 3.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

 

Part 4.  The Department of City Development, through its real estate section, shall process, at City’s expense, the recording of this ordinance and the executed lease amendments with the Milwaukee County Register of Deeds and shall forward the recording information, along with a final copy of this ordinance and the lease amendments, to the City Engineer and the City Comptroller.

 

Part 5.  This ordinance shall take effect and be in force from and after its passage and publication.
