Title

Substitute resolution authorizing execution of a project agreement with the Wisconsin Department of Transportation for the design and construction of Phase V of the Milwaukee Central Business District Primary Pedestrian Corridors Development Project under the Federal Congestion Mitigation/Air Quality Program at a total cost of $6,250,000 with a City cost share of $1,250,000.

Analysis

This resolution authorizes the execution of a project agreement with the Wisconsin Department  of Transportation for the programming, design and construction of sidewalk and other pedestrian related improvements on portions of East/West Wisconsin Avenue from North Prospect Avenue to North 10th Street and North Water Street from East St. Paul Avenue to East Knapp Street, to continue the development of primary pedestrian corridors through the downtown area.  The project will be funded primarily with federal funds from the Federal Congestion Mitigation and Air Quality Improvement Program.  The total cost of the project is $6,250,000, with a City share of $1,250,000, or 20 percent.

Body

Whereas, The Wisconsin Department of Transportation (WISDOT) has approved funding under the Federal Congestion Mitigation/Air Quality (CMAQ) program for projects which can be expected to reduce congestion, or to reduce vehicle emissions; and

 

Whereas, Preliminary approval has been received from WISDOT for the design and construction of pedestrian facility improvements included in Phase V of the project, and

 

Whereas, The Department of Public Works has begun efforts to improve the pedestrian environment and promote walking as an alternative means of transportation and provide a wayfinding system in the Milwaukee Central Business District; and

 

Whereas, East/West Wisconsin Avenue, North Water Street, and West Kilbourn Avenue have been identified as primary pedestrian corridors in the Downtown Master Plan; and

 

Whereas, Common Council Resolution File Number 981733, File Number 990806, File Number 021033, and File Number 040147, authorized the Commissioner of Public Works to execute  agreements for the programming and construction for previous stages of pedestrian corridor facility improvements on East/West Wisconsin Avenue, North Water Street and East/West Kilbourn Avenue under the CMAQ Program, and to undertake preliminary engineering for this pedestrian corridor development project; and

 

Whereas, Streetscape improvements have been implemented or are under construction on West Wisconsin Avenue from North 2nd Street to North 10th Street and East Wisconsin Avenue from the Milwaukee River to the intersection of East Mason Street and North Prospect Avenue, under Phases I, II, III, and IV of this project; and

 

Whereas, Construction of streetscape improvements proposed under Phase V will include West Wisconsin Avenue from North Plankinton Avenue to the Milwaukee River, thereby fully completing development of the primary east/west pedestrian corridor through the downtown area; and

 

Whereas, North 5th Street from West St. Paul Avenue to West Wisconsin Avenue, was recommended for CMAQ funding by the Wisconsin Department of Transportation to link the multimodal transportation depot at North 5th Street and East St. Paul Avenue to the primary  pedestrian corridor and has been included in this project stage; and

 

Whereas, Grant funding is also available to begin the construction of streetscape improvements on North Water Street from East St. Paul Avenue to East Knapp Street and extend the pedestrian wayfinding system developed under previous project stages into other remaining portions of the downtown area; and

 

Whereas, The WISDOT has submitted an Agreement for the fifth phase of this project to be executed by the City of Milwaukee for the design and construction of Phase V of this project; and

 

Whereas, The total cost of Phase V of the project is $6,250,000 with 80 percent of these costs, or $5,000,000 funded through CMAQ and the remaining 20 percent, or $1,250,000 funded by the City; and

 

Whereas, The State cannot proceed with any project cost overruns and/or changes in scope of more than 5% without prior Department of Public Works (DPW) approval; and

 

Whereas, The DPW shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project overruns and/or changes in scope approved by DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by DPW; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are hereby authorized to execute the project agreement for Phase V of the Milwaukee Central Business District Pedestrian Corridors Project under the Federal CMAQ program, copies of which are attached to and incorporated into this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized to undertake or engage a consultant to undertake preliminary engineering for the above-mentioned project, and to reimburse the WISDOT for preliminary engineering costs they incur for the improvement; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield values for preliminary engineering this project (Expenditure), and transfer to these accounts the amount required under the project agreement and City Accounting Policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
