Title

Resolution authorizing the Commissioner of Public Works to issue a permit allowing excavation in North 13th Street and West St. Paul Avenue where the pavement is less than three years old. (DPW)

Analysis

This resolution authorizes the Commissioner of Public Works to issue an excavation permit allowing installation of sewer and water laterals to serve the new Potawatomi administration building being constructed at the southwest corner of West St. Paul Avenue and North 13th Street.  Cuts in both streets are needed, and both streets are under warranty because their pavement is less than three years old.

Body

Whereas, The Forest County Potawatomi Community of Wisconsin plans to construct an administration building at the southwest corner of South 13th Street and West St. Paul Avenue; and

 

Whereas, This new building will require installation of storm sewer, sanitary sewer, and water laterals; and

 

Whereas, Given the scale of the building, the grade of the site and adjacent streets, and the proximity of City sewer and water mains, it is necessary to connect certain laterals to mains in South 13th Street and other laterals to mains in West St. Paul Avenue; and

 

Whereas, Both South 13th Street and West St. Paul Avenue have been recently paved and are under warranty because their pavement is less than three years old; and

 

Whereas, The three-year warranty on South 13th Street expires in October 2001 while the warranty in West St. Paul Avenue expires in July of 2003; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to issue excavation permits allowing cuts in pavement in South 13th Street and West St. Paul Avenue adjacent to the new Potawatomi administration building; and, be it

 

Further Resolved, That the pavement restoration shall be accomplished in accordance with the specifications and restrictions established by the Department of Public Works of the City of Milwaukee; and, be it

 

Further Resolved, That the Forest County Potawatomi Community of Wisconsin shall be responsible for any future defects in the affected pavement if such defects can be clearly attributable to the utility lateral installation work.
