Title
Resolution approving an agreement between the City of St. Paul, Minnesota, and the City of Milwaukee for provision of law enforcement personnel relating to public safety and security in conjunction with the 2008 National Republican Convention held in St. Paul.
Analysis
This resolution authorizes the Chief of Police to enter into an agreement with the City of St. Paul to dispatch members of the Milwaukee Police Department to the 2008 National Republican Convention to be held between September 1, 2008, and September 4, 2008, and to fully participate in public safety and security operations with other police departments located throughout the United States under the direction of the Unified Command.
Body
Whereas, The City of St. Paul, Minnesota, is a host city for the 2008 National Republican Convention (“2008 RNC”) to be held between September 1, 2008, and September 4, 2008; and
Whereas, The City of St. Paul is in need of procuring additional law enforcement services to provide the public safety and security measures required of an event the size and unique nature of the 2008 RNC, and has requested the participation of the City of Milwaukee Police Department; and
Whereas, The City of Milwaukee, through the Milwaukee Police Department, wishes to provide law enforcement services to the 2008 RNC pursuant to the police powers and law enforcement authority granted under the laws of the State of Wisconsin and City of Milwaukee; and
Whereas, According to the agreement, the Milwaukee Police Department personnel may not and will not act with some or all of the arrest or other police authority of a law enforcement officer of any law enforcement agency in Minnesota; and
Whereas, The City of Milwaukee shall be reimbursed for related time and expenses; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Chief of Police is authorized to enter into an agreement with the City of St. Paul to provide law enforcement personnel for public safety and security in conjunction with the 2008 National Republican Convention according to an agreement in substantially the same form as that attached to this file; and, be it
Further Resolved, That those police personnel selected for participation in the 2008 RNC, acting under the direction and control of the Chief of Police, shall remain employees of the Milwaukee Police Department throughout the period of their service as part of this effort, but they shall be subject to a structure of supervision, command and control coordinated through a unified law enforcement command and following unified principles and practices established throughout the law enforcement community, referred to as “Unified Command”; and, be it
Further Resolved, The Milwaukee Police Department personnel may not and will not act with some or all of the arrest or other police authority of a law enforcement officer of any law enforcement agency in Minnesota; and
Further Resolved, That those personnel selected for participation in the 2008 RNC shall undergo training, and shall fully participate in public safety and security operations with other police departments located throughout the United States; and, be it
Further Resolved, That the Milwaukee Police Department shall keep and maintain the appropriate books and records, as specified in the agreement, of the salaries and other compensation earned by the police personnel employed by the Milwaukee Police Department during the period of their service in conjunction with the 2008 RNC, and all other verifiable “mission-related expenses” associated with their participation in that effort, and to submit the Reimbursement Payment Form, which is attached to this file, to the City Comptroller at the conclusion of the Milwaukee Police Department’s participation in this effort, and the Comptroller shall submit the Reimbursement Payment Form, and other applicable documentation pursuant to the agreement, to the City of St. Paul no later than November 15, 2008, for reimbursement in accordance with the provisions of the agreement.
