Resolution amending Resolution File Number 001378 approving a plat of right-of-way required for the construction of a new bridge over the Milwaukee River in conjunction with the removal of the Park East Freeway (STH 145) to include approving an additional plat of right-of-way required for the construction and new alignment of the local streets associated with the removal of the Park East Freeway (STH 145). Analysis
This resolution authorizes the Commissioner of Public Works to execute and authorize the approval of plots of right-of-way required for the construction of a new bridge over the Milwaukee River and for the construction and new alignment of the local streets associated with the removal of the Park East Freeway (STH 145). This project lies within the City of Milwaukee and is partially funded by Federal/State funds. The City's share of real estate costs for the proposed improvements are estimated to be $180,000 of the total estimated cost of real estate of $1,020,000. This resolution also authorizes and directs the City Comptroller to transfer funds and establish subaccounts for the preliminary engineering work.

Whereas, The Common Council of the City of Milwaukee on November 6, 1999, adopted Resolution File Number 990947 authorizing and directing the Commissioner of Public Works to execute a project agreement with the Wisconsin Department of Transportation for various projects associated with the removal of the Park East Freeway (STH 145); and
Whereas, An environmental review process was undertaken for the project and a "Build" alternative selected; and
Whereas, The "Build" alternative includes the construction of a new vertical lift bridge over the Milwaukee River connecting West McKinley Avenue and East Knapp Street; and construction of local roads from North 6th Street to North Broadway; and
Whereas, An additional plat of right-of-way is required for the construction and new alignment of the local roads associated with removal of the Park East Freeway (STH 145); and
Whereas, Due to the "fast-tracking" of the project, the new bridge construction and local road construction must proceed in a timely manner; and
Whereas, HNTB, as part of the preliminary engineering process for this project, has completed a right-of-way plat to include the real estate needed for the new bridge and a right-of-way plat to include the real estate needed for the new roadway alignment; and
Whereas, It is necessary that the Common Council approve the plat of right-of-way for the project and authorize the WISDOT to acquire the land or interests in lands, as shown on the right-of-way plats; and
Whereas, Funding necessary for construction of the new bridge and local roads will be included in future resolutions; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the right-of-way plats for Project I.D. 1730-06-20, McKinley/Knapp Bridge over the Milwaukee River and Local Roads from North 6th Street to North Broadway Street be approved and that the City Engineer and the Commissioner of Public Works and City Development are authorized and directed to affix their signatures to the plats; and, be it
Further Resolved, That the WISDOT is hereby authorized to acquire lands or interests in lands as shown on the approved right-of-way plat for the McKinley/Knapp bridge project; and for the Local Roads from North 6th Street to North Broadway Street; and, be it
Further Resolved, That the City Engineer is authorized to sign relocation orders, awards of damages and other documents required by the right-of-way acquisition process; and, be it
Further Resolved, That minor revisions in the above plats to meet altered or unforeseen conditions encountered during acquisition of right-of-way are hereby authorized and approved; and, be it
Further Resolved, That the City Comptroller is hereby authorized and directed to revise within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for right-of-way acquisitions for the project (expenditure) and transfer to any of those accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amount reserved or $5,000, whichever is greater, as follows:
