Title:
Resolution directing negotiations with the Village of Greendale regarding the Village's request for an enhanced level of water service.
Analysis:
This resolution directs the City of Milwaukee negotiating team to begin negotiations with the Village of Greendale as described in Common Council Resolution File Number 080457. The Village of Greendale has requested an enhanced level of water service which, if granted, will create savings for the Village of Greendale. The deliverables of the negotiation are a revised water service agreement formalizing the enhanced level of water service and an intergovernmental agreement which contains a "non-compete" clause and an economic compensation provision in accordance with the requirements of Resolution File Number 080457.
 
Body:
Whereas, The Village of Greendale, a valued wholesale customer of the Milwaukee Water Works since 1964, has requested an enhanced level of water service from Milwaukee Water Works; and
 
Whereas, This request triggered an evaluation under the requirements of Common Council Resolution File Number 080457, the required reports were directed to be prepared in Resolution File Number 110589, and the reports were received under Communication File Number 110722; and
 
Whereas, The process next specifies establishing a negotiating team and beginning negotiations with the Village of Greendale with the objective of formalizing the enhanced level of service to be reflected in a revised water service agreement and to develop an intergovernmental agreement to compensate the City of Milwaukee for the benefits that will be realized by Greendale; and
 
Whereas, The City of Milwaukee's negotiating team was established in Resolution File Number 080457; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the negotiating team is directed to negotiate with the Village of Greendale to establish the enhanced level of service and draft an intergovernmental agreement between the City of Milwaukee and the Village of Greendale which contains a "non-compete" clause and an economic compensation provision in accordance with the requirements of Resolution 080457; and, be it
 
Further Resolved, That the water service agreement and intergovernmental agreement will be presented to the Common Council of the City of Milwaukee for approval; and, be it
 
Further Resolved, That Milwaukee Water Works will file with the Public Service Commission of Wisconsin a fully executed copy of the water service agreement.
