This substitute resolution approves and authorizes the execution of a project agreement with Milwaukee County for the improvement of North 43rd Street (CTH "G") between West Mill Road and West Good Hope Road. The agreement indicates that the proposed North 43rd Street cross section consists of two 26-foot wide roadways separated by a 14-foot median. This resolution authorizes the City Engineer to sign the project agreement and proceed with preliminary engineering work. This resolution also authorizes the City Comptroller to establish the necessary subaccount and transfer funds for preliminary engineering for the project. The total estimated preliminary engineering cost is $400,000 of which the City's share is $120,000.
BODY:
Whereas, The Common Council adopted Resolution File Number 872315 on March 29, 1988 agreeing to participate with Milwaukee County in the improvement of North 43rd Street (CTH "G") between West Mill Road and West Bradley Road; and
Whereas, Milwaukee County has completed the segment of North 43rd Street from West Good Hope Road to West Bradley Road and is continuing preliminary engineering work on the segment from West Mill Road to West Good Hope Road; and
Whereas, Several discussions between City and County staffs have been held regarding the proposed cross section for the segment of North 43rd Street from West Mill Road to West Good Hope Road; and
Whereas, We have now reached a general agreement on the proposed cross section which it is believed best meets the interests of the City of Milwaukee, Milwaukee County and the general public; and
Whereas, The agreed upon cross section consists of two 26-foot wide roadways separated by a 14-foot wide median; and
Whereas, The County has decided to proceed with the project and has requested the City of Milwaukee to approve and execute a project agreement detailing the cross section and the general design criteria; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the project agreement between the City and Milwaukee County, a copy of which is attached to Common Council Resolution File Number 970552 and is incorporated in this resolution by reference as though set forth in full, is hereby approved; and, be it,
Further Resolved, That minor changes in the agreement which do not change the intent of the agreement are hereby approved; and, be it
Further Resolved, That the City Engineer is authorized to sign the agreement and proceed with preliminary engineering work on the project in conjunction with the Milwaukee County; and, be it
Further Resolved, That the City Comptroller is authorized and directed to establish within the Capital Grant and Aids Project fund the appropriate subaccount for the project titled and transfer to this account the amount required for the City's preliminary engineering costs but not to exceed a 10 percent increase in the amount set aside as follows:

Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments upon request from Milwaukee County for the City's share of the preliminary engineering costs; and, be it
Further Resolved, That future action on right- of-way acquisition and construction cost will be contingent upon the availability of City funds and approval by the Common Council.
