Title

Substitute resolution authorizing and directing the Commissioner of Public Works and/or the City Engineer to negotiate and enter into a Jurisdictional Transfer Agreement with the State of Wisconsin Department of Administration, the Southeast Wisconsin Professional Baseball Park District, the Milwaukee Brewers Baseball Club, Imperial Parking, and the Redevelopment Authority of the City of Milwaukee (RACM) to acquire certain private roadways constructed in conjunction with Miller Park for public street purposes.

Analysis

This substitute resolution authorizes and directs the Commissioner of Public Works and/or the City Engineer to negotiate and enter into, and to take requisite acts under, a Jurisdictional Transfer Agreement with the State of Wisconsin Department of Administration, the Southeast Wisconsin Professional Baseball Park District, the Milwaukee Brewers Baseball Club, Imperial Parking, and the Redevelopment Authority of the City of Milwaukee (RACM) to acquire certain private roadways constructed in conjunction with Miller Park for public street purposes associated with the extension of W. Canal St from S. 25th St to S. Miller Park Way.

Body

Whereas, The Canal Street Extension has been included in the adopted Regional Transportation System Plan for Southeast Wisconsin since 1994; and

 

Whereas, The City is currently performing design and right-of-way acquisition for the Canal Street Extension project; and

 

Whereas, Common Council File Number 030453 approved the plat of right-of-way required for the improvement of West Canal Street between 6th and Miller Park, and

 

Whereas, The Canal Street Extension will provide a public benefit by providing a traffic mitigation route during reconstruction of the Marquette Interchange as well as provide primary access to the Milwaukee Road Shops TID; and

 

Whereas, A portion of the Canal Extension alignment was originally constructed by the Southeast Wisconsin Professional Baseball Park District in conjunction with construction of Miller Park and that portion is currently referred to as the Miller Park South Access Road (Frederick Miller Way); and

 

Whereas, The City has prepared an infrastructure plan for the Milwaukee Road Shops TID that contemplates the Miller Park East Access Road (S. Selig Drive) and North Access Road  (W Selig Dr.), also originally constructed in conjunction with Miller Park, also becoming public roads (along with the South Access Road) to improve access to the Milwaukee Road Shops TID; and

 

Whereas, The Miller Park Complex, including the South Access Road, East Access Road, and North Access Road, is currently under the jurisdiction of the State of Wisconsin Department of Administration who, in turn, leases stadium lands to the Southeast Wisconsin Professional Baseball Park District who, in turn, subleases to the Milwaukee Brewers Baseball Club who, in turn, leases to Imperial Parking, Inc. for management of parking operations at the stadium; and

 

Whereas, A Jurisdictional Transfer Agreement has been developed and is being negotiated to transfer jurisdiction of the Miller Park South, East, and North Access Roads by quit claim deed to the City for dedication as public right-of-way; and

 

Whereas, The Jurisdictional Transfer Agreement also includes conveyances of property or property interests at 620 South 44th Street (Lewinski property) and part of 3601 West Canal Street (Wheel House property) that are owned by the Redevelopment Authority of the City of Milwaukee, (RACM); and

 

Whereas, RACM scheduled a public hearing for February 17, 2005 on the proposed sale of the RACM parcels (or interests therein) as required by Wisconsin Statutes; and

 

Whereas, Pursuant to Wisconsin Statutes and as a condition precedent to the sale, lease, or transfer of land, RACM submits herewith a Term Sheet describing the general terms and conditions of the proposed sale (or transfers of interests) of the RACM-owned property; and

 

Whereas, The Jurisdictional Transfer Agreement also calls for allowing the Southeast Wisconsin Professional Baseball Park District the right to acquire the Water Works parcel located at 127 South 44th Street at fair market value in accord with Public Service Commission Regulations, and upon satisfaction of certain preconditions, at such time that the City and the City Plan Commission declare the facility surplus and no longer needed by the Water Works; and

 

Whereas, in the event the Southeastern Wisconsin Professional Baseball Park District exercises its right to acquire the Water Works parcel, the Jurisdictional Transfer Agreement calls for allowing the City to acquire the stadium north parking lot as a replacement site for the Water Works facility at fair market value; now, therefore be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and/or the City Engineer are authorized and directed to negotiate and enter into a Jurisdictional Transfer Agreement with the State of Wisconsin, the Southeast Wisconsin Professional Baseball Park District, the Milwaukee Brewers Baseball Club, Imperial Parking, and the Redevelopment Authority of the City of Milwaukee (RACM) to acquire certain private roadways constructed in conjunction with Miller Park for public street purposes associated with the extension of W. Canal St. from S. 25th St to S. Miller Park Way and to address the other matters referred to above, a draft copy of which is attached to Common Council Resolution File Number 041407, and is incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the authority hereby conferred upon the Commissioner of Public Works and/or City Engineer to negotiate the Jurisdictional Transfer Agreement includes reasonable modifications that do not substantially change the intent of this resolution or nature of the transaction; and, be it

 

Further Resolved, That the proper City officials are authorized to accept quit claim deeds for the Miller Park South, East, and North Access Roads for dedication as public right-of-way and to accept jurisdictional transfer from the State to the City, and to take all requisite acts contemplated by the Jurisdictional Transfer Agreement; and, be it

 

Further Resolved, That the City Plan Commission has approved the acquisition and dedication of these lands as well as City real estate acquisitions and dispositions contemplated herein; and, be it

 

Further Resolved, That the Term Sheet with respect to the proposed conveyance of RACM-owned parcels (or interests therein) at 620 South 44th Street and part of 3601 West Canal Street in conjunction with Jurisdictional Transfer Agreement is approved; and, be it

 

Further Resolved, That the potential conditional conveyance of the Water Works parcel located at 127 South 44th Street is approved subject to the terms and conditions of the Jurisdictional Transfer Agreement; and, be it

 

Further Resolved, That the potential conditional conveyance of the stadium north parking lot to the City as a potential replacement site for the Water Works facility located at 127 S. 44th Street is approved subject to the terms and conditions of the Jurisdictional Transfer Agreement.
