Title

Resolution authorizing the proper city officials to execute an intergovernmental cooperation agreement with the Milwaukee Metropolitan Sewerage District for work on City of Milwaukee facilities in conjunction with the District Tunnel under the Menomonee River at Emmber Lane.

Analysis

This resolution approves the entitled Intergovernmental Cooperation Agreement Between Milwaukee Metropolitan Sewerage District And The City of Milwaukee Water Works Concerning Reconstruction of a Water Main Within A District Tunnel Under The Menomonee River At Emmber Lane, and authorizes the Commissioner of Public Works to execute same on behalf of the City of Milwaukee. This agreement relates to utility work on city facilities necessitated by the rehabilitation of the District tunnel under the Menomonee River, being undertaken by the Milwaukee Metropolitan Sewerage District (MMSD) in 2008. This agreement provides generally for payment to MMSD of 100 percent of the costs of all work on city facilities (24” water main relay) necessitated by the tunnel rehabilitation project in accord with the Intergovernmental Cooperation Agreement. This resolution also authorizes the Commissioner of Public Works to prepare and/or review plans and estimates for the Emmber Lane tunnel utility work as necessary to accomplish the project. This resolution also authorizes the Comptroller to establish accounts as necessary to track the work and to make periodic payments to the MMSD for work undertaken on this project as approved by the Commissioner of Public Works.

Body

Whereas, The MMSD has scheduled the rehabilitation of the District tunnel under the Menomonee River at Emmber Lane in the City of Milwaukee, Milwaukee County; and

 

Whereas, There will be minimal work required on city utilities as a result of the design and construction associated with Emmber Lane tunnel work, resulting in significant time and cost savings to the Milwaukee Water Works; and

 

Whereas, The Intergovernmental Cooperation Agreement indicates that Milwaukee Water Works will pay 100 percent of the cost of the 24” water main relay; and

 

Whereas, It has been estimated that for the District tunnel work at Emmber Lane, the cost of utility alterations (24” water main relay) for Milwaukee Water Works will be $500,000; and

 

Whereas, In order for the MMSD to be reimbursed for the 100 percent share of the 24” water main utility alteration cost on the District tunnel work at Emmber Lane, the MMSD requires the entering into Intergovernmental Cooperation Agreement with the Milwaukee Water Works; and

 

Whereas, The MMSD has provided the City of Milwaukee with the necessary intergovernmental cooperation agreements to facilitate reimbursement of costs in the alteration of City of Milwaukee Water Works facilities; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Intergovernmental Cooperation Agreement for Milwaukee Water Works, attached to this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to review and/or prepare plans as necessary to accomplish the required utility alterations associated with the District tunnel work at Emmber Lane and is authorized to allow MMSD to include city utility work in the District tunnel work at Emmber Lane contract; and, be it

 

Further Resolved, That the funding to cover the 100 percent City of Milwaukee cost of the 24” water main relay for Milwaukee Water Works estimated to be $500,000, are and/or will be placed in DPW departmental accounts as part of the city budget process in budget year necessary to accommodate the project scheduling and the Local Accounts Receivable Report (LARR) billings; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized and directed to create within the Capital Improvements Fund, Grant and Aid Projects, the necessary project/grant chartfield values for engineering and construction for the project (expenditure) and transfer to any of these accounts the amounts required under the grant agreement and city accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share and local share of $5,000, whichever is greater, as follows:

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to make periodic payments as necessary to accommodate the works required for the District tunnel at Emmber Lane utility alterations as required under the aforementioned utility agreements.
