Analysis
This resolution directs the installation and construction of certain public improvements which have been determined to be nonassessable by the Commissioner of Public Works. The City cost of the projects approved by this resolution is estimated to be $2,472,500. The total estimated cost of these projects is $40,650,500.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions determining it necessary and in the public interest to construct nonassessable improvements; and
Whereas, Plans, specifications and cost estimates have been prepared for the following described improvements:
2nd and 9th Aldermanic Districts
N. 76th St. - W. Florist Ave. to W. Clinton Ave. (ST30981002) (2140-08-02) File Number 050156: Adjustments to City of Milwaukee Water, Sanitary Sewer, and Underground Conduit facilities necessitated by a Wisconsin Department of Transportation Paving Project. (City Share Non-assessable Paving Fund -- $105,500) The total adjustment cost of this project including this request is $105,500. The total estimated cost of this project including this request is $398,000. Previously authorized for this portion of the project is $292,500. Current estimated cost of the entire project including this resolution is $37,677,000. The original cost of the entire project was $37,304,000. This project is anticipated to be completed during the 2007 construction season. These funds are to be transferred to the construction account ST30981010 (2140-08-71)

(Nonassessable Water Fund -- $70,000) The total estimated cost of this project including this request is $85,000. This project is anticipated to be completed during the 2007 construction season.

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized and directed to proceed with said work; and, be it
Further Resolved, That the Department of Public Works is authorized to use the funding as specified in the above description of work; and, be it
Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the city’s share of the costs for said project: N. 76th St. (ST30981002) (2140-08-02); and, be it
Further Resolved, That upon the completion of project: N. 76th St. (ST30981002) (2140-08-02), and a determination of the actual costs, it is understood that if the City of Milwaukee’s share is less than the amount previously paid, the difference will be refunded to said City; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts.
