This ordinance revises various provisions of the code for purposes of correcting errors, clarifying language and eliminating obsolete provisions.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 64-01-1 and 2 of the code is repealed and recreated to read:

 

64-01. Adoption of State Code.

 

1. MOBILE HOME PARKS. Sections Adm. 65.01, 65.02, 65.03(1) to (3), (5) to (13), 65.04 to 65.07, 65.09(1)(a) and (c), and (2) to (4), 65.10(1), (3) and (4), and 65.11 to 65.17, Wis. Adm. Code, as amended.

 

2. CAMPGROUNDS AND CAMPING RESORTS. Chapter HFS 178, Wis. Adm. Code, as amended.

 

Part 2. Section 68-01 of the code is amended to read:

 

68-01. Adoption of State Code. Except as otherwise provided in this chapter, the city of Milwaukee adopts ch. 97, Wis. Stats., chs. ATCP [[66,]] 75 >>,80<< and [[HSS]] >>HFS<< 196, Wis. Adm. Code, as amended, and where pertaining specifically to food operation premises, Comm 14 and 16, ILHR 51, 52, 54, 55 and 64, Wis. Adm. Code, as amended, as part of this code.

 

Part 3. Section 75-15-5 of the code is amended to read:

 

75-15. Ambulance Certification Regulations.

 

5. FEES. An applicant filing an initial application for a certificate or an application for renewal shall pay the fee required in [[s. 81-3]] >>ch. 60<<. If an initial application or application for renewal is denied, no fee paid shall be refunded.

 

Part 4. Section 95-1-6-b of the code is amended to read:

 

95-1. Direct Sellers.

 

6. LICENSE.

 

b. License Issued. Upon payment of the fee and the signing of the statement, the clerk shall license the applicant as a direct seller. The clerk shall deliver to each licensee an official license, which must be carried by the direct seller while engaged in employment and produced upon the request of any customer or police officer. The license is for the use of the licensee only and is nontransferable.

 

Part 5. Section 222-59 of the code is amended to read:

 

222-59. Door Interlock or Contact and Lock. All existing passenger elevators, except roped hydraulic elevators, shall be provided with an approved interlock or contact and lock on each hoistway entrance door or gate in the same manner as required by [[the Wisconsin elevator code]] >>ch. Comm 18, Wis. Adm. Code, as amended,<< for new elevators. All necessary requirements of emergency keys and keyways shall also be provided.

 

Part 6. Section 246-3-1 and 6 of the code is amended to read:

 

246-3. Minimum Requirements for Trailer House Communities.

 

1. WATER SUPPLY; SLOP SINKS; DEPENDENT UNITS. Every trailer house community shall be provided with an ample and adequate supply of water taken from the city water supply system, extended on the premises so as to provide water supply to every 8 spaces, provided further that no trailer house shall be more than 80 feet from the source of water supply, all constructed in accordance with the design, size and of materials as required by the department of public works, Milwaukee water works, and [[ch. H62 of the]] >>s. Comm 82.51,<< Wis. Admin. Code, but no repairs, alterations or replacements shall be made to the present water piping systems which are now adequate, unless such repairs, alterations or replacements shall conform to s. ILHR 82.51, Wis. Adm. Code. At each such water supply, for spaces as aforesaid, an approved slop sink or basin shall be provided and connected to the city sewerage system.

 

6. ELECTRICAL INSTALLATION. All electrical installations shall be in compliance with [[the Wisconsin state electrical code]] >>ch. Comm 16, Wis. Adm. Code, as amended,<< and ch. 222. Underground wiring shall be installed in compliance with the above codes.

 

Part 7. Section 309-41-5-c of the code is amended to read:

 

309-41. Participation of City Residents in Public Works Contracts.

 

5. ANNUAL PROGRAM REPORTS.

 

c. If not all construction contracts included a residency requirement or if some contracts contained a requirement of less than [[21%]] >>25%<< of worker hours, the department shall state the reason for this difference.

 

Part 8. Section 320-29-3-f of the code is renumbered 320-29-3-g.

 

Part 9. Section 320-29-3-f of the code is created to read:

 

320-29. Parking Fund.

 

3. PARKING REVENUE.

 

f. Revenues from fees charged for towing and storage of vehicles.

 

Part 10. Section 320-29-4 of the code is amended to read:

 

4. PARKING EXPENDITURES. Parking fund revenues shall be used to defray administrative, operational and enforcement costs related to >>towing and storage of vehicles,<< parking meters, parking facilities, special privilege parking permits, and parking regulations, including a payment in lieu of taxes, payments to a debt service fund to amortize parking purpose loans, payments for installation of parking regulation signs and parking regulation law enforcement. In addition, revenues shall be used for the purchase of parking meters and costs associated with enforcement of judgments entered as a result of violation of parking regulations and for the acquisition, construction and equipping of off-street parking facilities, but for no other purposes.
