This original resolution accepts a sewer easement located in the area west of West Canal Street and south of West Milwaukee Road in the 8th Aldermanic District and authorizes and directs the proper City officers to execute a Sewer Easement and Agreement SE 2820 allowing Ingeteam, Inc to construct a building within a the City of Milwaukee sewer easement.
Body
Whereas, The City of Milwaukee has submitted a request for an easement required to maintain the existing 36-inch storm sewer in the area located west of West Canal Street and south of West Milwaukee Road in Parcel 2 of Certified Survey Map No. 8034, a division of Block 3, Lot 1, Menomonee Valley Industrial Park lying in the Southeast ¼ of the Northwest ¼ of Section 36, Township 7 North, Range 21 East; and
Whereas, Said easement is located in lands presently owned by Ingeteam Inc (Owner); and
Whereas, Sewer Easement and Agreement SE-2820, granting permission to the City to maintain the 36-inch storm sewer has been granted by the Owner, and approved as to content by the City Engineer; and
Whereas, Sewer Easement and Agreement SE-2820 will also grant the City the right of entry in and across the property and with the right to inspect, enlarge, reconstruct and relocate as may become applicable said sewers; and
Whereas, The Owner has requested the City’s permission to construct a building in and over a portion of the easement area; and
Whereas, The City will allow the construction of said portions of the building in and over a portion of the easement area, subject to conditions stipulated in Easement and Agreement document known as SE-2820; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Easement and Agreement SE-2820, said Easement and Agreement being attached to this Common Council Resolution File Number 100610 and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That after said Easement and Agreement document has been executed by the proper City officers, it shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
