Analysis
This ordinance changes the process by which public passenger vehicle driver's licenses are issued for both new and renewal applicants. At present, both types of application are submitted to the police department for review. If the police department files no objection to the application, it is sent to the common council for approval. Under this ordinance, if the police department files no objection, the city clerk is authorized to issue the license.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 100-54-4-a of the code is amended to read:
100-54. Driver's License.
4. ISSUANCE.
a. Applications shall be referred to the chief of police who shall cause an investigation to be made and report his or her findings to the [[licensing committee]] >>city clerk<<. If the police chief files no objection to an application, the [[license shall be forwarded to the common council for approval]] >>city clerk shall issue the license<<. If the police chief files an objection to an application, the license shall be forwarded to the licensing committee for its recommendation as to whether or not each license should be issued.
Part 2. Section 100-54-5-a of the code is amended to read:
5. RENEWAL.
a. Procedure for Renewal. Applications for [[the]] renewal shall be made to the city clerk. The clerk shall refer the application to the chief of police for review. If the chief of police indicates that the applicant still meets the licensing qualifications, [[the application shall be referred to the common council for approval]] >>the city clerk shall issue the license<< unless a written objection has been filed with the city clerk at least [[30]] >>45<< days prior to the date on which the license expires. The objection may be filed by any interested person. If a written objection is filed, or if a determination is made that the applicant no longer meets the licensing qualifications, the application shall be forwarded to the licensing committee for its recommendation to the common council.
