As part of the city's asbestos hazard control regulations, this ordinance requires the commissioner of health to adopt an asbestos inspection and sampling protocol for buildings to be demolished or renovated. The protocol shall be based on state and federal regulations and shall specify the health department's inspection and sampling requirements prior to demolition or renovation of buildings. The protocol shall be available upon request at the health department and a copy shall be provided to the legislative reference bureau. Failure to comply with the protocol is a violation of the asbestos hazard control regulations.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 66-12-5.5 of the code is created to read:
66-12. Asbestos Hazard Control.
5.5. PROTOCOL FOR DEMOLISHING AND RENOVATING BUILDINGS. a. The commissioner shall adopt an asbestos inspection and sampling protocol for buildings to be demolished or renovated. The protocol shall be based on state and federal regulations and shall specify the minimum departmental inspection and sampling requirements prior to beginning demolition or renovation of buildings.
b. The commissioner shall make the protocol available upon request at the department and shall furnish a copy of the protocol to the legislative reference bureau.
Part 2. Section 66-12-9-L of the code is created to read:
9. PROJECT VIOLATIONS.
L. Failure to comply with all the requirements of the asbestos inspection and sampling protocol for buildings to be demolished or renovated, under sub. 5.5.
