This substitute resolution appropriates $181,651 from Special Purpose Account Number 01-053-8001, Municipal Court Commissioner Project, to be expended in accordance with the recommendations contained in the final report of the Municipal Court Resource Needs Evaluation Study Committee, including a $80,000 cap on funding for computer changes. This resolution also directs that no further staffing changes related to this project be made for 6 months following implementation of this resolution and that an independent evaluation of the project shall be conducted 6 months following its full implementation.
BODY:
Whereas, The City of Milwaukee, through authority granted by state statutes, has created the office of municipal court commissioner; and
 
Whereas, The 1998 City of Milwaukee budget set aside money in a special purpose account for payment of salaries of municipal court commissioners, technology changes in the municipal court and other projects; and
 
Whereas, Common Council File Number 970683, adopted December 16, 1997, provided that funds in the Municipal Court Commissioner Special Purpose Account were to be released only by separate Common Council resolution; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that funds in the Special Purpose Account Number 01-053-8001, Municipal Court Commissioner Project, be authorized for expenditure by Municipal Court for the following specified public purposes:
 
One-time costs ($137,100) Equipment ($14,600) $2,300 - 1 tape recorder $5,000 - 1 PC workstation for bailiff at the Criminal Justice Facility (CJF) $5,000 - 1 PC workstation for court clerk at CJF $2,300 - furniture for court clerks' office at CJF
 
Services ($122,500) $80,000 - Information services; changes in Municipal Court Management Information System (to accommodate court commissioners, new schedules, multiple locations for the same hearing type, reports, notices)
 
$39,500 - Remodeling of Municipal Intake Courtroom to accommodate intake and pre-trials
 
$3,000 - Communications in CJF for additional computer workstations (bailiff, court clerk)
 
Continuing Costs ($34,551) Salaries ($19,551) $12,301 - .5 FTE Court Clerk I
 
$7,250 - 207 additional hours of court commissioner services at $35 per hour
 
Services ($15,000) $5,000 - Court commissioner education (up to 5 part-time court commissioners)
 
$10,000 - Delivery services for in- custody and pre-trial case files
 
; and, be it
 
Further Resolved, That no further staffing changes related to this project shall be made for 6 months following implementation of this resolution; and, be it
 
Further Resolved, That an evaluation of the Municipal Court Commissioner Project shall be conducted 6 months following its full implementation by an outside, independent group to be determined by the Common Council; and, be it
 
Further Resolved, That the funds shall be expended in accordance with the recommendations contained in the final report of the Municipal Court Resource Needs Evaluation Study Committee, including a $80,000 cap on funding for computer changes; and, be it
 
Further Resolved, That the City Comptroller is authorized and directed to transfer $10,000 from account 01-053-8001 to sub-account 01-053-8002 to be expended by the Department of Administration for consulting services for the Municipal Court Resource Needs Evaluation Study Committee.
