Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to execute a revised State and Municipal Agreement with the Wisconsin Department of Transportation for the programming and construction of traffic signal and roadway improvements using Highway Safety Improvement Program funds for this project in the 7th Aldermanic District.   The revisions for the project will result in an increase in City funding of $2,000 and in Federal funding of $18,000 for design.  Approval of construction will be in a future resolution.  The total cost of the project will increase to $270,000 with a Federal share of $243,000 and City share of $27,000.
Body
Whereas, The approval of the State and Municipal agreement using Highway Safety Improvement Program funding for safety improvements at the intersection of West Fond du Lac Avenue and North Sherman Boulevard was previously approved under Common Council File Number 101057; and
 
Whereas, The City of Milwaukee has requested that additional improvements be made at the intersection of West Fond du Lac Avenue and North Sherman Boulevard including median modifications to increase visibility of opposing traffic for left-turning vehicles, and the installation of monotube mast arm mounted traffic signals over each lane, and other signal improvements necessary to bring them into compliance with the Manual on Uniform Traffic Control Devices; and
 
Whereas, The total cost of the project will increase to $270,000 with a Federal share of $243,000 and City share of $27,000; and
 
Whereas, The revisions for the project will result in an increase in City funding of $2,000 and in Federal funding of $18,000 for design; and
 
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with the revised State and Municipal Agreement to be executed by the City of Milwaukee for the programming and construction of the project under the HSIP; and
 
Whereas, WISDOT has submitted the revised State and Municipal Agreement for execution by the City of Milwaukee for the design and construction of:

Whereas, The State cannot proceed with any project cost overruns or changes in scope of more than 5% without prior Department of Public Works approval; and
 
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns or changes in scope approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns or changes in scope as approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works and the Comptroller are authorized to execute the revised State and Municipal Agreement for the programming and the design-construction of the aforementioned project with Highway Safety Improvement Program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to complete preliminary engineering for this project; and, be it
 
Further Resolved, That the Department of Public Works shall request in a future resolution funding for the construction phases of this project; and be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for preliminary engineering for the project or expenditure and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share or $5,000, whichever is greater as follows:
