Whereas, FN 960765 adopted on 1/17/97 appropriated $10,000 from the Outside Counsel/Expert Witness Fund Special Purpose Account for the purpose of hiring outside counsel Friebert, Finerty & St. John, S.C. to represent the City in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 97-CV-0009822; and
Whereas, FN 980717 adopted on 9/23/98 appropriated an additional $5,000 and FN 981209 adopted on 12/18/99 appropriated an additional $15,000; and FN 001559 adopted on 3/20/01 appropriated an additional $10,000; and FN 010296 adopted on 7/17/01 appropriated an additional $10,000; and
Whereas, There is a remaining negative balance of -$2,082.92 and the June billing amounts to 7,299.12 and additional funding in the amount of $10,000 is necessary; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the sum of $10,000 be appropriated from the Outside Counsel/Expert Witness Fund Special Purpose Account No. 001-1490-0001-S157-2001-006300 to the City Attorney's Office for the purpose of paying outside counsel in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 97-CV-0009822; and, be it
Further Resolved, That all charges be approved by the City Attorney's Office upon the presentation of invoices for services at a rate not to exceed $110 per hour; and that the application of the funds appropriated herein to a case other than that specifically referred to herein shall be subject to the further direction of the Common Council; and, be it
Further Resolved, That the proper City officers be and are hereby authorized and directed to make whatever fund transfers are necessary or appropriate to carry out the provisions of this resolution.
