Substitute resolution approving a member agreement between the City of Milwaukee (CITY), Milwaukee Public Library (MPL), and the Milwaukee County Federated Library System (SYSTEM) relative to the payment of reciprocal borrowing charges among member communities.

Analysis

This substitute resolution authorizes the Milwaukee Public Library (MPL) to enter into a member agreement which is between the City of Milwaukee (City), Milwaukee Public Library (MPL), and the Milwaukee County Federated Library System (SYSTEM).

Body

Whereas, Milwaukee County Federated Library System was established to facilitate the orderly and efficient operation of cooperative library services throughout the Milwaukee County; and

Whereas, In 1994 the CITY and MPL entered into a seven-year lease with the SYSTEM whereby the SYSTEM leases certain space within the MPL's Central Library; and

Whereas, The lease has been subsequently extended through December 31, 2005; and

Whereas, The CITY and MPL have previously entered into an agreement with the SYSTEM relative to membership in the SYSTEM and for the MPL to act as a Resource Library for the SYSTEM; and

Whereas, The MPL has been a member of the SYSTEM since its formation in 1973; and

Whereas, On November 8, 2000 the Common Council approved Resolution File No: 000875, authorizing the 2001/2002 Computer Services Agreement with the SYSTEM; and

Whereas, The SYSTEM, at its December 18, 2000 meeting of the Board of Trustees approved withdrawal of the Computer Services Agreement and incorporating its provisions in the Member Agreement; and

Whereas, The SYSTEM at its January 22, 2001 meeting of the Board of Trustees approved the 2001 through 2004 Member Agreement that incorporates the provisions of the previous Computer Services Agreement; and

Whereas, It is beneficial to the CITY and the MPL to rescind the 2001/2002 Computer Services Agreement and enter into the 2001 through 2004 Member Agreement with the SYSTEM; now therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the 2001/2002 Computer Services Agreement with the SYSTEM authorized by Resolution File No: 000875 be rescinded; and, be it

Further Resolved, By the Common Council of the City of Milwaukee, that the MPL and the proper CITY officers are hereby authorized to enter into the 2001 through 2004 Member Agreement by the City Attorney's Office.
