Analysis
Currently the Milwaukee code permits an owner of a single or 2-family residence anywhere in the city to disconnect downspouts or sump pumps and discharge them to finished grade providing certain conditions are met (for example, the discharge shall not discharge to a street alley or public way; the discharge must flow parallel to or away from the nearest property line).  This ordinance extends those code provisions to all other buildings located in those areas of the city served by combined sewers.
 
The ordinance also permits owners of buildings wishing to disconnect downspouts or sump pumps to request the commissioner of neighborhood services to waive compliance with the specific regulations specified herein upon submission to and acceptance by the commissioner of a discharge system designed by a registered professional engineer or architect for purposes of complying with the intent of the regulations.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1.  Section 225-4-2-a-1-0 of the code is amended to read:
225-4. Drainage of Yard Area and Roofs.
2.  ROOF RAINWATER LEADERS (CONDUCTORS).
a-1.  Single-and 2-family dwellings and detached buildings accessory to single or 2-family dwellings >>in any area of the city, and all other buildings located in those areas of the city served by combined sewers<< may discharge roof rainwater leaders, conductors or downspouts to finished grade.  All discharges to finished grade for reasons of non-connection or disconnection of a previously connected system must meet all of the following provisions:
 
Part 2.  Section 225-4-2-a-2 of the code is created to read:
a-2.  Owners of dwellings and buildings referenced in subd. 1 may request the commissioner to waive the provisions of subd. 1 upon submission to and acceptance by the commissioner of a discharge system designed by a registered professional engineer or architect for purposes of complying with the intent of subd. 1.
 
Part 3.  Section 225-8-1-0 of the code is amended to read:
225-8.      Sump Pump Regulations. 1.  Except >>for dwellings and<< buildings described in s. 225-4-2-a-1, all sump pumps shall be connected to a storm sewer or combined sewer when available and abutting on the property unless otherwise approved by the commissioner.  [[Single and 2-family dwellings]] >>Dwellings and buildings described in s. 225-4-2-a-1<< may disconnect sump pumps from a storm sewer or combined sewer and discharge sump pumps to finished grade.  All discharges of sump pumps to finished grade for reasons of non-connection or disconnection of a previously connected system must meet all of the following provisions:
 
Part 4.  Section 225-8-1-f of the code is created to read:
f.  Owners of dwellings and buildings which may disconnect sump pumps as provided in this subsection may request the commissioner to waive the provisions of this subsection upon submission to and acceptance by the commissioner of a discharge system designed by a registered professional engineer or architect for purposes of complying with the intent of this subsection.
