Title
Substitute resolution approving a plat of right-of-way required for the construction of a new bridge over the Milwaukee River in conjunction with the removal of the Park East Freeway (STH 145).
Analysis
This substitute resolution approves a right-of-way plat and subsequent acquisition of land or interests required to construct a new bridge over the Milwaukee River connecting West McKinley Avenue and East Knapp Street as part of the removal of the Park East Freeway project. The approval is contingent upon one of the "Build" alternatives, currently under environmental review, being chosen. This substitute resolution also authorizes and directs the City Comptroller to transfer funds to cover the real estate cost. The estimated cost is $200,000, of which the City share is $30,000.

Whereas, The Common Council of the City of Milwaukee on November 9, 1999, adopted Resolution File Number 990947 authorizing and directing the Commissioner of Public Works to execute a project agreement with the Wisconsin Department of Transportation for various projects associated with the removal of the Park East Freeway (STH 145); and
Whereas, There are two "Build" alternatives currently being considered in the environmental review process for the project; and
Whereas, Each "Build" alternative includes the construction of a new vertical lift bridge over the Milwaukee River connecting West McKinley Avenue and East Knapp Street; and
Whereas, Due to the "fast-tracking" of the project, the new bridge construction must proceed in a timely manner; and
Whereas, To accommodate the new bridge, the acquisition of several parcels is necessary; and
Whereas, HNTB, as part of the preliminary engineering process for this project, has completed a right-of-way plat to include the real estate needed for the new bridge; and
Whereas, Should a "Build" alternative be chosen, it is necessary that the Common Council approve the plat of right-of-way for the project and authorize the WISDOT to acquire the land or interests in lands, as shown on the right-of-way plat; and
Whereas, Funding necessary for construction of the new bridge will be included in future resolutions; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the right-of-way plat for Project I.D. 1730-06-20, McKinley/Knapp Bridge over the Milwaukee River be approved and that the City Engineer and the Commissioner of Public Works and City Development are authorized and directed to affix their signatures to the plat; and, be it
Further Resolved, That Common Council approval of the right-of-way plat is contingent upon a "Build" alternative being selected for the project through the environmental review process; and, be it
Further Resolved, That the WISDOT is hereby authorized to acquire lands or interests in lands as shown on the approved right-of-way plat for the McKinley/Knapp bridge project; and, be it
Further Resolved, That the City Engineer is authorized to sign relocation orders, awards of damages and other documents required by the right-of-way acquisition process; and, be it
Further Resolved, That minor revisions in the above plat to meet altered or unforeseen conditions encountered during acquisition of right-of-way are hereby authorized and approved; and, be it
Further Resolved, That the City Comptroller is hereby authorized and directed to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for right-of-way acquisition for the project (Expenditure) and transfer to any of those accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amount reserved or $5,000, whichever is greater, as follows:

Further Resolved, That the City Engineer is directed to submit the final bridge design concept to the Common Council for review prior to undertaking final contract plans.
