Title

Substitute resolution modifying the policy for the acceptance of grants for additional law enforcement services from tax exempt public or quasi-public entities and relative to application, acceptance and funding of a UWM Grant (Police Department), and approving a Law Enforcement Services Grant Agreement with the University of Wisconsin System.

Analysis

This resolution modifies the policy for accepting law enforcement grants from tax exempt public or quasi-public entities.  That policy was originally adopted under Common Council File No. 011573, adopted May 6, 2002.  The modification adds an additional alternate criteria which must be satisfied in order for such a grant to be accepted.  The new criteria is that the tax exempt entities operations must occasion the need for additional police services in adjacent areas of the city.  The specific grant agreement approved under the resolution is between the City and the University of Wisconsin System acting on behalf of the University of Wisconsin-Milwaukee.  Under the terms of the grant agreement, UWM will fund the overtime cost for the provision of two additional police officers to patrol the UWM neighborhood for a 4 hour period, as determined by MPD, between 5:00 p.m. and 4:00 a.m., Thursday, Friday, and Saturday nights from April 15th through May 15th for the calendar year 2003. The grant is for the not-to-exceed amount of $4,400 and the agreement will terminate prior to May 15, 2003 if that amount is exhausted.

Body

Whereas, The Common Council adopted a policy for accepting law enforcement services grants from tax exempt or quasi tax exempt entities via Common Council File No. 011573, adopted May 6, 2002; and

 

Whereas, The Common Council desires to amend that policy and in support of that amendment, the Common Council finds in addition to the findings set forth in Common Council File No. 011573, that: tax exempt public or quasi-public entities such as large universities may by the nature of their operations occasion the need for additional police services in areas of the city adjacent to their campuses or sites.  Therefore, the Common Council hereby adds as an alternative to criteria 3c, set forth in Common Council File Resolution 011573, a criteria 3d which is: "The nature of the entities' operations occasion the need for additional police services in adjacent areas of the City."; and

 

Whereas, The Common Council further finds that accepting grants from public or quasi-public entities qualifying under the criteria set forth in Common Council File Resolution 011573, as modified herein, is in the public interest because:

 

1.  The grant will enable the Milwaukee Police Department (MPD) to assign additional personnel to City areas adjacent to the University of Milwaukee  (UWM) campus and thereby enhance the public safety and convenience in those areas; and

 

2.  The grant will relieve the general City property taxpayers from funding the cost of the additional law enforcement services being provided to the areas adjacent to the UWM campus; and

 

Whereas, The University of Wisconsin System ("UW System") is an agency of the State of Wisconsin; and

 

Whereas, The UW System owns and operates the UWM campus; and

 

Whereas, All real and personal property owned and operated by the UW System is State of Wisconsin property and therefore exempt from general property taxation pursuant to sec. 70.11(1), Stats.; and

 

Whereas, Based upon the policy criteria enumerated in Common Council Resolution File No. 011573, as modified herein, and the findings herein, the MPD is eligible for grant funds from the UW System for a UWM Grant to fund additional law enforcement services; and

 

Whereas, The UWM System has offered the Milwaukee Police Department a grant to pay for two additional police officers to patrol the UWM neighborhood from 5:00 p.m. and 4:00 a.m., Thursday, Friday, and Saturday nights from April 15th through May 15th, 2003; and

 

Whereas, The Chief of Police has indicated a willingness to provide these services in accordance with the terms and conditions of the grant agreement attached to this file; and

 

Whereas, The operation of this grant from 1/01/2003 to 12/31/2003 would cost approximately $4,000.00 of which $0.00 (0%) would be provided by the City and $4,000.00 (100%) would be provided by grantor, but in no case will grantor provide more than $4,400.00; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that grants for the provision of additional law enforcement services be accepted if the grantor qualifies under the criteria established in Common Council Resolution File No. 011573, as modified herein; and, be it

 

Further Resolved, That by the Common Council of the City of Milwaukee, that the grant application from the UW System meets all criteria established in Common Council Resolution File No. 011573, as modified herein, and, on that basis, the MPD shall accept this grant without further approval unless the terms of the grant change, as indicated in Common Council File 940843; and, be it

 

Further Resolved, That the Chief of Police is authorized to execute the Law Enforcement Services Grant Agreement (Revised) with the UW System, a copy of which is attached to this file; and, be it

 

Further Resolved, That the City Comptroller's Office is authorized to:

 

1.  Commit funds within the Project/Grant Parent of the 2003 Special Revenue-Grant and Aid Projects Fund, the following amount for the program titled: "UWM Grant":

2.  Create the necessary Grant and Aid Project/Grant and Project/Grant levels, budget against these Project/Grant values the amount required under the grant agreement;

Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to:

 

1.  Expend from the amount budgeted sums for the specified purposes, as indicated in the grant budget and incur costs consistent with the award date.

 

2.  Transfer funds within the project budget as long as the amount expended for each specific purpose does not exceed the amount authorized by the budget by 10%.
