Substitute resolution authorizing the Commissioner of Public Works to issue permits to CP Rail System to temporarily close the North 13th Street at-grade crossing north of West Mt. Vernon Avenue and to close the North 12th Street at-grade crossing north of West Mt. Vernon Avenue on an interim basis while the Office of the Commissioner of Railroads investigates and issues a Finding of Fact and Order relative to the permanent closure of the crossing, in the 4th Aldermanic district of the City of Milwaukee.

This resolution grants permission to the Commissioner of Public Works to issue permits to CP Rail System, allowing roadway closures at the at-grade railroad crossings located on North 12th Street and North 13th Street, north of West Mt. Vernon Avenue, and allows the North 12th Street crossing to remain closed until the State of Wisconsin Office of the Commissioner of Railroads issues a Finding of Fact and Order relative to the permanent closure of the crossing.
BODY:
Whereas, CP Rail System (CP) operates mainline railroad trackage running in an east-west direction between West St. Paul Avenue and the Menomonee River; and
Whereas, CP wishes to realign several tracks of the mainline trackage in the vicinity of North 12th Street and North 13th Street and, in order to do this, the North 12th Street and North 13th Street at-grade railroad crossings located north of West Mt. Vernon Avenue will need to be closed; and
Whereas, CP intends to petition the State of Wisconsin Office of the Commissioner of Railroads (OCR) for a Finding of Fact and Order asking that the North 12th Street railroad crossing remain permanently closed to vehicular traffic; and
Whereas, CP has asked that the North 12th Street crossing be allowed to remain closed while the OCR investigates the permanent closure in order to avoid costly signal relocations and pavement repairs which may be unnecessary providing CP receives a favorable ruling from the OCR; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to issue the necessary permits to CP Rail System to close North 12th Street and North 13th Street, at the railroad crossings located immediately north of West Mt. Vernon Avenue for the purpose of railroad crossing realignment and repair; and, be it
Further Resolved, That closure of the North 13th Street crossing will take place first and the duration of the closure will be for five working days, after which the North 12th Street closure will take place; and, be it
Further Resolved, That providing CP rail has petitioned the OCR for permanent closure, CP is hereby allowed to maintain the closure of the North 12th Street railroad crossing until the OCR issues a Finding of Fact and Order relative to whether the crossing may remain permanently closed to vehicular traffic; and, be it
Further Resolved, That CP will, upon issuance of the Finding of Fact and Order by the OCR, implement the conditions of the order prior to the end of 1998 or as agreed to by the Commissioner of Public Works.
