Substitute resolution relative to application, acceptance, and funding of a Wisconsin Department of Natural Resources Urban Nonpoint Source and Storm Water Management Grant.
Analysis
This substitute resolution authorizes the Department of Public Works, Infrastructure Services Division to apply for, accept and fund a Wisconsin Department of Natural Resources Urban Nonpoint Source and Storm Water Management Grant in the amount of $250,000 with a City share of $150,000 and a grantor share of $100,000.  The purpose of the project is to fund the installation of storm water treatment devices and structural best management practices at various locations in West Good Hope Road.  Funding under this grant will enable the City to control pollutants and improve water quality.
Body
Whereas, The City of Milwaukee appears to be eligible for grant funds from the Department of Natural Resources for the installation of storm water treatment devices and structural best management practices at various locations in West Good Hope Road; and
 
Whereas, The operation of this Wisconsin Department of Natural Resources Urban Nonpoint Source and Storm Water Management Grant from the Department of Natural Resources from January 1, 2004 would cost $250,000 of which, $150,000 would be provided by the City and $100,000 would be provided by the grantor; and
 
Whereas, The local out-of-pocket City share required to receive the grant is $150,000; and
 
Whereas, The purpose of this project is to improve the quality of storm water runoff in the Lincoln Creek, which will improve water quality; and
 
Whereas, Under the terms of Section 144.25 of the Wisconsin Statues and Chapter NR 120.08 of the Wisconsin Administrative Code, the City of Milwaukee is eligible for additional grant funds from the Department of Natural Resources for Nonpoint Source Water Pollution Abatement Nonpoint Source Grant; and
 
Whereas, It would appear that the City involvement in a grant aid project involving storm water quality would result in the following major benefits to the City: controlling pollutants entering the City's storm sewer system and improving water quality; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that application to the Department of Natural Resources is authorized and the Department of Public Works, Infrastructure Services Division shall accept this grant without further Common Council approval unless the terms of the grant change as indicated in Common Council File 030712 (Grant Ordinance); and, be it
 
Further Resolved, That the City Comptroller is authorized to:
 
1.  Commit funds within the Capital Project/Grant Parent Account of the 2004 Special Revenue Grant and Aids Projects, fund the following amounts for the project/program titled Department of Natural Resources for Nonpoint Source Water Pollution Abatement Nonpoint Source Grant Program:

2.  Create a Special Revenue Fund - Grant and Aid Projects and the Necessary Project/Grant Chartfield Values at the Project, Segment, Phase and/or Activity Levels; and to budget to the Project, Segment, Phase and/or Activity Level the amount required under the grant agreements.
 
3.  Establish the necessary City share project values; and, be it
 
Further Resolved, That these funds are appropriated to the Department of Public Works, Infrastructure Services Division which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That Infrastructure Services/Sewer Maintenance commit $150,000 to fund the project titled Department of Natural Resources for Nonpoint Source Water Pollution Abatement Nonpoint Source Grant Program:

Further Resolved, That the Commissioner of Public Works of the Department of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the Commissioner of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
