This substitute resolution vacates the above portions of alley in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by Marquette University for use of a pedestrian way that is consistent with their Campus Identity and Beautification Plan.
BODY:
Whereas, It is proposed that the East-West alley from North 11th Street to North 12th Street and a portion of the North-South alley, located between West Wisconsin Avenue and West Wells Street, be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
 
Whereas, This proposed vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that said portions of alley, as indicated by Exhibit "A" and bound and described by:
 
All that part of the alleys in Block 185 of A. Eldred's Subdivision, a recorded subdivision, in the Northwest 1/4 of Section 29, Township 07 North, Range 22 East, described as follows:
 
All of the East-West 20.00 foot wide alley, as platted, lying between the west line of North 11th Street, extended, and the east line of North 12th Street, extended, and that part of the North-South 20.00 foot wide alley, as platted, lying between the north line of the East-West alley and a line drawn between the Southwest corner of Lot 1 and the Southeast corner of Lot 14 in said Block 185, is vacated; and, be it
 
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair of entrance, maintenance, construction and repair with reference thereto shall continue as if said portions of alley had not been vacated.
