This ordinance will expand the range of uses permitted in a portion of the site to include hotels and various services such as travel agencies, delivery or copying services, medical clinics or labs, and barber or beauty shops. This ordinance also will establish signage standards in the same portion of the project.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. There is added to the Milwaukee Code a new section to read:
 
Section 295-810(2)(a).0042.
 
(1) In accordance with the provisions of Section 295-810(1) of the Milwaukee Code relating to the establishment of planned development districts, the Common Council of the City of Milwaukee approves the 8th amendment to the general plan for a general planned development known as Park Place, a copy of which is attached to this Common Council File as Exhibit "A" which is on file in the Office of the City Clerk and made a part thereof as though fully set forth herein.
 
(2) The zoning map is amended so as to include in a General Planned Development District (GPD) the area bounded and described as follows:
 
Parcel 2 of Certified Survey Map No. 5555, Recorded June 5, 1991, as Document No. 6487562 and lands in the Southeast 1/4 of Section 18, Township 8 North, Range 21 East, in the City of Milwaukee, Milwaukee County, Wisconsin, bounded and described as follows:
 
Commencing at a point in the East line of said Southeast 1/4, said line also being the centerline of North 107th Street 883.06 feet North 00 deg. 31 min. 23 sec. East of the Southeast corner of said Southeast 1/4; thence North 89 deg. 28 min. 37 sec. West 60.00 feet to the point of beginning, said point being the Northeast corner of Lot 3 of Certified Survey Map No. 4639, said point lying on the Southerly right of way line of West Park Place and the Westerly right of way line of North 107th Street; thence South 00 deg. 31 min. 23 sec. West along said Westerly line 657.80 feet; thence continuing along said Westerly line South 18 deg. 34 min. 26 sec. West 160.56 feet to a point in the North line of West Good Hope Road; thence Westerly along said North line as follows: thence South 86 deg. 46 min. 45 sec. West 311.74 feet to a point of curvature; thence Southwesterly along a curve to the left (having a radius of 1717.02 feet and a long chord of 401.74 feet which bears South 80 deg. 03 min. 39 sec. West) an arc distance of 402.66 feet; thence South 86 deg. 46 min. 45 sec. West and parallel with the South line of said Southeast 1/4 Section 227.68 feet; thence North 24 deg. 45 min. 56 sec. West 327.38 feet to a point in the Southerly right of way line of West Park Place, said point lying in a curved line; thence along said Southerly line as follows: thence Northeasterly along a curve to the right (having a radius of 748.51 feet and a long chord of 273.13 feet which bears North 80 deg. 00 min. 38 sec. East) an arc distance of 274.67 feet to a point of tangency; thence South 89 deg. 28 min. 37 sec. East 100.00 feet to a point of curvature; thence Northwesterly along a curve to the left (having a radius of 400.00 feet and a long chord of 480.18 feet which bears North 53 deg. 38 min. 14 sec. East) an arc distance of 515.02 feet to a point of tangency; thence North 16 deg. 45 min. 05 sec. East 108.38 feet to a point of curvature; thence Northeasterly along a curve to the right (having a radius of 250.00 feet and a long chord of 300.11 feet which bears North 53 deg. 38 min. 14 sec. East) an arc distance of 321.89 feet to a point of tangency; thence South 89 deg. 28 min. 37 sec. East 100.00 feet to the point of beginning.
 
Excepting therefrom that part known as Parcel 1 and Outlot A of Certified Survey Map 5223, Recorded December 27, 1988, as Document No. 6239353, and excepting Parcel 1 of Certified Survey Map 5555, Recorded June 5, 1991, as Document No. 6487562, and excepting therefrom those parts taken or used for street.
 
(3) The requirements set forth in said general plan attached to this File as Exhibit "A" constitute the zoning regulations for the area contained in such planned development district herein described, except that construction shall not be permitted in any segment of said tract until a detailed plan prepared in accordance with Section 295-813(3) of the Milwaukee Code of Ordinances has been approved by the Common Council and the zoning ordinance is amended; except that improvement may be permitted to the extent that such improvements are shown in detail and included in the approved general plan.
 
Part 2. Any persons, firm, company or corporation owning, controlling, or managing any building or premises wherein or whereon there shall be placed or there exists anything in violation of the terms of this ordinance; or who shall build contrary to the plans or specifications submitted to and approved by the Commissioner of Building Inspection, or any person, firm, company or corporation who shall omit, neglect or refuse to do any act required in this ordinance shall be subject to the penalties provided in Section 200-19 of the Milwaukee Code of Ordinances.
 
Part 3. In accord with the provisions of Section 295-814(4) of the Milwaukee Code, the City Clerk shall transmit a facsimile copy of the general plan and a certified copy of the action taken by the Common Council to the Department of City Development.
 
Part 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. The Common Council declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases or other portions be declared void or invalid.
