Substitute resolution appropriating $173,830.79 from the 2003 Common Council Contingent Fund to reimburse the Neighborhood Improvement Development Corporation $152,827.47 in receivership expenses for the public nuisance abatement project and $21,003.32 to pay select special charges from the property tax bill for the property located at 2638 North Palmer Street.
ANALYSIS
This Resolution provides for payments of $173,830.79 from the 2003 Common Council Contingent Fund by providing $152,827.47 to the Neighborhood Improvement Development Corporation to reduce the amount owed by this city for nuisance abatement projects throughout the City of Milwaukee and provides $21,003.32 to be allocated to the City Treasurer to remove the special charges relating to nuisance abatement for the property located at 2638 North Palmer Street as this matter has been settled between the Neighborhood Improvement Development Corporation and the estate of the property owner.
BODY
Whereas, The Common Council and the Mayor have made it a priority for the City of Milwaukee to collect the costs of its Nuisance Abatement Program through whatever legal means are reasonable; and
Whereas, The City of Milwaukee has had a cooperation agreement with the Neighborhood Improvement Development Corporation to act as receiver in the abatement of various nuisances for which funds were provided by the City of Milwaukee to the Neighborhood Improvement Development Corporation via the Department of Neighborhood Services Housing Demolition, and Preservation Special Purpose Account; and
Whereas, The cost of abatement on several occasions exceeded the funds provided for various nuisance abatement projects throughout the city resulting in approximately $500,000.00 due to the Neighborhood Improvement Development Corporation as of January 1, 2003; and
Whereas, On a number of occasions the Neighborhood Improvement Development Corporation had lien rights as a result of the nuisance abatement litigation which were transferred to the City of Milwaukee and ultimately placed on the property tax bill as a special charge resulting in a number of Neighborhood Improvement Development Corporation liens being collected by the City of Milwaukee through its real estate tax collection system; and
Whereas, The placement of six of these charges resulted in city tax collection of $152,827.47 made up of

$152,827.47; and
Whereas, The property located at 2638 North Palmer Street was the result of a nuisance abatement lawsuit resulting in an Neighborhood Improvement Development Corporation lien of $21,003.32 which was placed on the City of Milwaukee property tax bill as an approved lien of the receiver for which the Neighborhood Improvement Development Corporation and the estate of the owner has reached agreement on payment; and
Whereas, The nuisance abatement special purpose account is now under the management of the City Attorney's office as a result of recent consolidation of the nuisance abatement program eliminating the participation of Neighborhood Improvement Development Corporation as receiver even though the cooperation agreement is still in place; and
Whereas, The resolution of the funds owed to the Neighborhood Improvement Development Corporation is considered in the cooperation agreement by the City providing funds to Neighborhood Improvement Development Corporation to cover its costs as receiver, now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that $173,830.79 be allocated from the 2003 Common Council contingent fund account number 0001-9990-C001-006300 to reimburse the Neighborhood Improvement Development Corporation $152,827.47 in its receivership expenses for the public nuisance abatement project and that $21,003.32 be allocated to the City of Milwaukee Treasurer to pay select special charges from the property tax bill for the property located at 2638 North Palmer Street; and, be it
Further Resolved, That the proper city officials are directed to take steps necessary to accomplish the provisions of this resolution.
