Analysis

This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held.  The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.

Body

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:

 

1st Aldermanic District

 

W. Custer Ave. - N. 33rd St. to N. 35th St. (ST211050121) File Number 031434:  Asphalt pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, and grading.  (Assessable Reconstruction Paving Fund -- $32,400; Nonassessable Reconstruction Paving Fund -- $75,000).

 

5th Aldermanic District

 

N. 80th St. - W. Keefe Ave. to W. Nash St. (ST211050119) File Number 041031:  Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where needed, sodding, and grading.  (Assessable Reconstruction Paving Fund -- $22,000; Nonassessable Reconstruction Paving Fund -- $35,000).

 

8th Aldermanic District

 

W. Canal St. - Miller Park Ring Road to Falk Dr. (SW170050101) File Number 041468:  Install sanitary sewer.  (Assessable Expansion of Capacity Sewer Fund -- $280,500; Nonassessable Expansion of Capacity Sewer Fund -- $2,681,000).

 

W. Canal St. - Miller Park Ring Road to Falk Dr. (SW170050112) File Number 041468:  Install storm sewer.  (Assessable Expansion of Capacity Sewer Fund -- $273,500; Nonassessable Expansion of Capacity Sewer Fund -- $726,500).

 

S. 37th St. - W. Burnham St. to W. Mitchell St. (ST211050116) File Number 041031:  Asphalt pavement resurfacing, replace all curb and gutter sidewalk and driveway approaches, sodding, grading, and tree removal where necessary.  (Assessable Reconstruction Paving Fund -- $34,000; Nonassessable Reconstruction Paving Fund -- $110,000).

W. Forest Home Ave. - S. 35th St. to S. 42nd St. (ST30683601) (2121-01-70) File Number 981633:  Asphalt pavement resurfacing, replace curb and gutter, sidewalk and driveway approaches where needed, sodding, grading, and tree removal where necessary.     These funds are to be transferred to the construction account ST30683610.  (City Share Assessable Paving Fund  -- $68,500;City Share Non-assessable Paving Fund -- $10,000; Grantor Paving Fund -- $384,000; Grantor Paving Reimbursable Cash Fund -- $60,000).

 

12th and 14th Aldermanic District

 

S. 6th St. - S. Chase Ave. to W. Maple St. (ST320030101) (2060-08-70) File Number 981633:  Concrete pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, grading, and tree removal where necessary.   These funds are to be transferred to the construction account ST320030110.  (City Share Assessable Paving Fund  -- $111,300; City Share Non-assessable Paving Fund -- $30,000; Grantor Paving Fund -- $560,000; Grantor Paving Reimbursable Cash Fund -- $85,000).

 

14th Aldermanic District

 

Alley between E. Euclid Ave., S. Hanson Ave., S. Nevada St., and E. Oklahoma Ave. (ST212050109) File Number 030748:  Concrete alley pavement reconstruction, replace some abutting walk or driveway approaches, grading, and storm drainage facilities where needed.  (Assessable Alley Paving Fund -- $63,800; Nonassessable Alley Paving Fund -- $35,000).

 

15th Aldermanic District

 

N. 13th St. - W. Meinecke Ave. to W. Clarke St. (ST211050110) File Number 041031:  Asphalt pavement reconstruction, replace all curb and gutter, replace sidewalk and driveway approaches where needed, sodding, and grading.  (Assessable Reconstruction Paving Fund -- $71,600; Nonassessable Reconstruction Paving Fund -- $110,000).

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and

 

Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it

 

Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it

 

Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it

 

Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following projects:  W. Forest Home Ave. (ST30683601) (2121-01-70) and S. 6th St. (ST320030101) (2060-08-70); and, be it

 

Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the city's share of the costs for said projects W. Forest Home Ave. (ST30683601) (2121-01-70) and S. 6th St. (ST320030101) (2060-08-70); and, be it

 

Further Resolved, That upon the completion of projects W. Forest Home Ave. (ST30683601) (2121-01-70) and S. 6th St. (ST320030101) (2060-08-70) and a determination of the actual costs, it is understood that if the City of Milwaukee's share is less than the amount previously paid, the difference will be refunded to said City; and, be it

 

Further Resolved, That projects W. Custer Ave. (ST211050121), N. 80th St. (ST211050119), W. Canal St. (SW170050101), W. Canal St. (SW170050112), S. 37th St. (ST211050116), S. 6th St. (ST320030101) (2060-08-70), Alley E. Euclid Ave. (ST212050109), and N. 13th St. (ST211050110) will be billed after January 1, 2007, but not before 12 months after the project contract has been completed and project W. Forest Home Ave. (ST30683601) (2121-01-70) will be billed after January 1, 2008, but not before 12 months after the project contract has been completed; and, be it

 

Further Resolved, That the following projects be deleted from the 2005 Paving Program:
