Title

Resolution authorizing City entry into Green Schoolyards Redevelopment Program Funding Agreement and Conservation Easements with MMSD and MPS for MPS properties at various locations in the City of Milwaukee.

Analysis

This resolution authorizes the City of Milwaukee to enter into Green Schoolyards Redevelopment Program Funding Agreement and Conservation Easements with MMSD and MPS for installation of green infrastructure at various MPS properties.

Body

Whereas, The City of Milwaukee is the owner of record of Milwaukee Public Schools (MPS) sites concerning which the MPS Board has the duty of care, control and management under Wis. Stat. 119.16 (1m) and (3)(b) and Wis. Stat. 119.60 (2); and

 

Whereas, the District has established the MPS Green Schools Program (“Program”) to
streamline the provision of funding to various MPS schools that have previously completed
conceptual planning under Consultant Agreement No. G98028P01 for proposed Green Infrastructure (“GI”) projects (“Projects” or “Project”) at selected MPS schools (“Cohort” or “Cohorts”); and 

 

Whereas, Cohorts 9, 10 and 11 have completed the conceptual planning stage and are now
ready to proceed with the implementation of a Work Plan to develop specific Green Infrastructure
Project design and subsequent construction at said Cohort schools; and

 

Whereas, This Agreement provides specific funding to MPS in order to assist with the
establishment and implementation of a Work Plan and subsequent construction for such Projects
to install the planned Green Infrastructure at said Cohort schools; and

 

Whereas, After the completion of construction of a Project the MMSD receives a Conservation Easement from the City for that specific Project, limited to the GI installed through the specific Project; and

 

Whereas, The conservation easement to be used post-installation, for each school site, will be in substantially the same form and substance as the template conservation easement to submitted to this file; now therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Green Schoolyards Redevelopment Program Funding Agreement (G98035) submitted to this file is hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter the funding agreement document in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to cause the City to enter, for each school site, post-installation of the green infrastructure improvements, the conservation easement in the same form, or in substantially the same form and substance, as is submitted in this file and approved by that Resolution File; and (iii) to take such further acts as may be contemplated or required to be taken by the City under those documents so as to carry out the intent and purpose of this resolution and those documents.
