This ordinance requires that the form licensed junk dealers and collectors use when making junk purchases include the following new, additional information:
1. A statement as to whether the seller has a junk collector's license and, if so, the number of said license.
2. A written declaration from the seller stating whether the items being sold are personal property and, if not, whether they were acquired under a junk collector's license or if the seller is a licensed plumber, electrician or home improvement contractor.
BODY:
Whereas, Section 92-3-7-a of the Milwaukee Code of Ordinances establishes procedures for recording purchases made by junk dealers and collectors; and
Whereas, These procedures are intended to prevent the sale of stolen, scavenged or otherwise illicitly-obtained items to junk dealers and collectors; and
Whereas, Requiring individuals selling items to junk dealers and collectors to provide additional information about related occupational licenses that they hold would enhance the City of Milwaukee's efforts to curb the trade in illicitly-obtained items; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 92-3-7-a of the code is repealed and recreated to read:
92-3. Junk Collectors and Dealers. 7. REGULATIONS. a. Sales Form. No junk collector or junk dealer may purchase, in cash, any ferrous or nonferrous metal, with the exception of aluminum cans, without properly recording each sale on a form approved by the police department. The form must include: a-1. A transaction number. a-2. The date of the transaction. a-3. The printed name and address of the seller. a-4. A statement as to whether the seller holds a junk collector's license and, if so, the number of said license. a-5. The type and weight of the property sold along with an additional description of the property, if applicable. a-6. A statement as to whether the property being sold is the wholly-owned personal property of the seller and, if not, whether the property was obtained under a junk collector's license or if the seller is a licensed electrician under s. 222-11, a certified home improvement contractor under s. 95-14, or a licensed plumber under ch. 145, Wis. Stats. a-7. The amount of the sale. a-8. The seller's signature.
