This resolution authorizes the Department of Public Works to continue operating and maintaining, on a temporary basis, certain street lighting facilities in vacated right-of-way adjacent to the Master Lock Company property, and to bill them for all associated costs.
 
 
BODY:
Whereas, The Common Council of the City of Milwaukee adopted Resolution File No. 961460 on January 17, 1997, vacating portions of the North 32nd Street and West Clarke Street right-of-way; and
 
Whereas, It is the intent of the Master Lock Company to pursue the vacation of additional portions of the public right-of-way in the future; and
 
Whereas, Certain City-owned street lighting facilities were located within the vacated areas; and
 
Whereas, It is not in the City's interest to own street lighting facilities in any vacated portion of the right-of-way; and
 
Whereas, It is in the best interests of the City and the Master Lock Company that the City continue to operate and maintain the street lighting facilities in the vacated portions of North 32nd Street and West Clarke Street on a temporary basis; and
 
Whereas, The Master Lock Company has agreed to reimburse the City for all costs associated with said operation and maintenance; now, therefore, be it
 
Resolved, That the Commissioner of Public Works is authorized to convey to the Master Lock Company the street lighting facilities located in the vacated portions of the North 32nd Street and West Clarke Street right-of-way; and, be it
 
Further Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized and directed to execute an agreement with the Master Lock Company to operate and maintain said street lighting facilities, a copy of the agreement being attached and hereby made part of the file; and, be it
 
Further Resolved, The Commissioner of Public Works is authorized to make non-substantive changes in the attached agreement; and, be it
 
Further Resolved, The Commissioner of Public Works is directed to bill the Master Lock Company to recover costs of normal and routine maintenance, of electric power used, and of any requested or necessary removal, replacement, or relocation of facilities.
