Title
Substitute resolution approving an Agreement between the City of Milwaukee and the Milwaukee Area Technical College for the provision of defensive driving courses.
Analysis
This resolution authorizes the City Clerk to execute an Agreement between the City of Milwaukee and the Milwaukee Area Technical College for the provision of defensive driving courses. Completion of this class is required of applicants for a public passenger vehicle driver's license and is also one of the conditions that the Municipal Court has required of traffic defendants who intend to stipulate to a lesser offense carrying lower traffic points than traffic points allotted for conviction of the original charge. The class is also serves as a referral option used by Municipal Court Judges in the adjudication of traffic cases.

Whereas, Completion of a defensive driving and safety course class is one of the conditions required of applicants for a public passenger vehicle driver's license; and
Whereas, Completion of a defensive driving course is one of the conditions that the Municipal Court Judges have required of traffic defendants who intend to stipulate to a lesser offense carrying lower traffic points than those associated with the original charge; and
Whereas, The Milwaukee Area Technical College has agreed to continue to provide sessions of this class, and to provide necessary administrative support for reporting the completion status of each referral, following expiration on February 29, 2012, of the agreement authorized in Common Council File Number 091324; and
Whereas, There is no cost to the City for providing the course under the current or proposed agreement, and the cost to students for the 4-hour course is reduced under the proposed agreement from $30.98 to $29.10; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Clerk is authorized to execute the agreement with the Milwaukee Area Technical College, attached to this file, effective the first day of March, 2012, for provision of defensive driving classes for a 2-year period and renewable by the City Clerk for an additional 2-year period as set forth in the agreement; and, be it
Further Resolved, As contractually agreed upon, there shall be no cost to the City of Milwaukee for its participation, and the defensive-driving class shall be funded by fees paid by applicants for a public passenger vehicle driver's license or defendants who are referred to it by the Municipal Court.
