Resolution authorizing and directing the proper City Officers to execute the sewer and water license agreements and quit claim deed and accepts the sewer easement after it has been approved as to form and execution by the City Attorney for sewers and water main in vacated North Hopkins Street. (Infrastructure Services Division)

Analysis

Due to the vacation of North Hopkins Street, north of West Douglas Avenue, two sewer license agreements, a quit claim deed and a sewer easement were required to be prepared.  This resolution authorizes and directs the proper City Officers to execute the sewer and water license agreement and quit claim deed and accepts the sewer easement after it has been approved as to form and execution by the City Attorney.

Body

Whereas, A portion of North Hopkins Street, extending from a point 145.81 feet north of West Douglas Avenue to the north side of the Union Pacific Railroad Right-Of-Way was vacated per Common Council Resolution File Number 990020; and

 

Whereas, The vacation of this portion of North Hopkins Street requires two sewer license agreements, a quit claim deed and a sewer easement to protect the ability of the City to maintain, repair and replace the sewer and water facilities; and

 

Whereas, The Union Pacific Railroad Company has prepared sewer license agreement SL-2667B, allowing the storm sewer in their property.  A copy of said agreement is attached to this Common Council File No. 010073 and incorporated in this resolution by reference as though set forth in full; and

 

Whereas, The Union Pacific Railroad Company has prepared water license agreement, WE-870, allowing the water main in their property.  A copy of said agreement is attached to this Common Council File No. 010073 and incorporated in this resolution by reference as though set forth in full; and

 

Whereas, The Department of Public Works has prepared a quit claim deed QCD-2683 giving the sanitary and storm sewers in Milwaukee County property to Milwaukee County, a copy of said Quit Claim Deed is attached to this Common Council File No. 010073 and incorporated in this resolution by reference as though set forth in full, and

 

Whereas, The Department of Public Works has prepared a sewer easement, SE-2667A, for the storm sewer and water main in Milwaukee County property, a copy of said easement is attached to this Common Council File No. 010073 and incorporated in this resolution by reference as though set forth in full; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute the Sewer License Agreements and Quit Claim Deed; to transmit said Agreements and Quit Claim Deed to the appropriate parties for execution, record documents with the Register of Deeds of Milwaukee County as needed, distribute copies, and transmit the original documents to the City Comptroller for safekeeping; and , be it

 

Further Resolved, That upon acceptance of sewer easement SE-2667A, the document is to be recorded with the Register of Deeds of Milwaukee County, copies distributed, and the original document transmitted to the original document transmitted to the City Comptroller's office for safekeeping.
