Analysis

This ordinance increases various fees and forfeitures effective January 1, 2006.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 60-3-1, 3 and 4 of the code is amended to read:

 

60-3.                     Animal Fancier Permit and Fees.

1.  The fee for each animal fancier permit shall be [[$30]] >>$50<<.

 

3. There shall be an additional [[$17]] >>$20<< late fee for any new or renewal permit application and fee that is received by the department later than the fifth day after the applicant has received the permit application.

 

4.  A [[$22]] >>$25<< delayed inspection fee shall be charged whenever a permit holder fails to schedule and allow a department inspection of the premises as provided in s. 78-7-2-b-2.

 

Part 2.  Section 60-7 of the code is amended to read:

60-7.  Animal Licenses.

1.  The fee for an unspayed or unneutered cat or dog shall be [[$20]] >>$24<<.

 

2.  The fee for a spayed or neutered cat or dog shall be [[$10]] >>$12<<.

 

3.  Application for a license may be made from January 1 to April 1 without paying a late filing fee.  Any license applied for after April 1 shall cost an additional [[$8]] >>$10<< for an unspayed or unneutered cat or dog, and [[$4]] >>$5<< for a spayed or neutered cat or dog, unless the applicant has proof that the animal has been acquired or that it has just reached the age of 5 months within the last 30 days prior to application or that the applicant has established city residency within the last 30 days prior to the application.

 

Part 3.  Section 60-9-1 and 2 of the code is amended to read:

60-9.  Abestos Project Permit.

1.  Review and inspection of permit application: [[$70]] >>$75<<.

2.  Fees for a permit shall be computed as follows:

a.  For a period not exceeding 3 days of asbestos project work: [[$135]] >>$150<<.

b.  For a period of 4 to 10 days of asbestos project work: [[$270]] >>$300<<.

c.  For a period exceeding 10 days of asbestos project work: [[$400]] >>$440<< or 1% of the total cost of the asbestos abatement project, whichever is greater.

 

Part 4.  Section 60-13-2 of the code is amended to read:

60-13.                     Bed and Breakfast Establishment Permit.

2.  The annual fee for a bed and breakfast permit shall be [[$47]] >>$50<<.

 

Part 5.  Section 60-15-2 of the code is amended to read:

60-15.  Campground and Camping Resort Fees.

2.  The annual fees for campgrounds and camping resorts shall be:

a.  1-25 sites: [[$70]] >>$75<<.

b.  26-50 sites: [[$90]] >>$100<<.                     

c.  51-100 sites: [[$110]] >>$120<<.

d.  Over 100 sites:[[$185]] >>$205<<.

 

Part 6.  Section 60-16-1-a to 3 of the code is amended to read:

60-16.  Closing Out Sale License.

1.  FEE.  Fee for each license shall be the total of 2 charges:

a-1.  For a period not exceeding 15 days: [[$30]] >>$34<<.

a-2.  For a period not exceeding 30 days: [[$66]] >>$68<<.

a-3.  For a period not exceeding 60 days: [[$90]] >>$100<<.

 

Part 7.  Section 60-17-2 of the code is amended to read:

60-17.  Dry Cleaning Establishment Permit (Coin-operated).

Part 8.  Section 60-20-2 of the code is amended to read:

60-20.  Filling Station License.

Part 10.  Section 60-21-5 of the code is amended to read:

Part 11.  Section 60-23-3-a-1 and 2, b-1 and 2, c, d-1 and d-2 of the code is amended to read:

60-23.  Temporary Food Dealer's License.

3.  FEES. 

a.  Restaurants.  a-1.  The fee per temporary event for the 1st day of operation of each temporary restaurant and for a temporary restaurant that operates no more than one day is [[$50]] >>$55<<.

a-2.  The fee per temporary event for each additional day of operation for each temporary restaurant is [[$25]] >>$30<<.

b.  Retail. b-1.  The fee per temporary event for temporary food operations that process food at the point of sale is [[$50]] >>$55<<.

b-2.  The fee per temporary event for temporary food operations that do not process food at the point of sale is [[$30]] >>$35<<.

Part 12.  Section 60-25-1 and 2 of the code is amended to read:

60-25.                     Food Operations - Plan Examinations.

1.  The fee for each portion of a food operations - plan examination for fire protection, plumbing or ventilation equipment shall be [[$20]] >>$40<<.

2.  The fee for each complete plan review shall be [[$80]] >>$160<<.

 

Part 13.  Section 60-27-1 to 3 of the code is amended to read:

60-27.  Food Operations - Preinspections.

Part 29.  Section 60-84-2-a and b of the code is amended to read:

60-84.                     Tire Transporters and Generators.

Part 30.  Section 60-91-1-a, 2-a, 3-a, 4-a, 5-a and 6-a of the code is amended to read:

60-91.  Weighing and Measuring Device Licenses.

1.  LINEAR METERS.  a.  The fee for each linear meter license shall be [[$20]] >>$22<<.

Part 31.  Section 81-2-2 to 4 of the code is amended to read:

81-2.                     Alarm Business License.

3.  License renewal applications shall be filed at least 45 days prior to the date on which the license expires.  There shall be an additional fee for the filing of a late renewal application of [[$50]]>>$75<<.

4.  If an applicant is not granted a license, a portion of the license fee shall, upon written request, be returned to the applicant in the amount of [[$100]]>>$125<<.

 

Part 32.  Section 81-4-2-a and b of the code is amended to read:

81-4.  Amusement Premises, Distributors, Machines and Videogame Centers.

2.a.  Videogame center licenses: [[$400]] >>$450<<.

Part 33.  Section 81-13-2 of the code is amended to read:

a.  The fee for each certified survey map shall be $65.

b.  In addition, a fee of $222 shall be paid for each certified survey map.  This fee is intended to cover the cost of map review by the department of public works.

 

Part 38.  Section 81-22-1 of the code is amended to read:

81-22.  Class "A" Fermented Malt Beverage Retailer's License (Package Store).

1.  GENERAL.  For the excavation required for the construction or repair of an individual storm building sewer, sanitary building sewer, combined building sewer, water service, or any combination thereof laid simultaneously in a single excavation or in more than one excavation connected by tunneling or boring, the fee shall be [[$80]] >>$89<<.

2.  MAIN OR CONDUIT.  For the excavation required for the laying or repair of a main or conduit in each block the fee shall be [[$70]] >>$78<<.

Part 85.  Section 200-33-35-e of the code is repealed. (Note: The provision being repealed reads as follows:

Part 97.  Section 200-33-46-c-2 of the code is amended to read:

Part 100.  Section 200-33-67.2-a, b-1 and c of the code is amended to read:

67.2.  ZONING, PLAN COMMISSION/COMMON COUNCIL. 

a.  Planned Development.  The fee for each planned development application shall be [[$1,100]] >>$1,200<<.

b.  Overlay Zone Plan Review.

b-1.  In an overlay zone where development plan review is required, the fee for the plan review shall be [[$75]] >>$85<< plus [[$2]] >>$2.50<< for each linear foot of lot frontage as measured at the street line.  Frontage on an alley shall not be included in this calculation.

c.  Zoning Amendment.  The fee for a zoning map amendment pursuant to s. 295-307 shall be [[$570]] >>$630<<.

 

Part 101.  Section 200-33-68 of the code is repealed and recreated to read:

68.  ZONING STATEMENT.  The required fee for a signed statement as to current zoning shall be $100 plus $75 per hour for research.

 

Part 102.  This ordinance takes effect January 1, 2006.
