Analysis

This ordinance eliminates the contracting goals for use of small business enterprises relative to deconstruction contracts.  It also allows non-profit organizations to qualify as small business enterprises for the purpose of entering into deconstruction contracts.

Part 1. Section 370-1-10 of the code is created to read:

 

370-1.  Definitions.

 

10. DECONSTRUCTION means the systematic dismantling of a structure, or portion thereof, to maximize the salvage of materials for reuse, in preference over salvaging materials for recycling, energy recovery, or sending the materials to the landfill.

 

Part 2. Section 370-1-13 of the code is created to read:

 

13. NON-PROFIT ORGANIZATION means an entity that qualifies for tax-exempt status by the internal revenue service because its mission and purpose are to further a social cause and provide a public benefit. 

 

Part 3. Section 370-5-1-d of the code is created to read:

 

370-5.  Goals of Contracting Departments.

Part 4. Section 370-26 of the code is created to read:

 

370-26.  Certification of Non-Profit Organizations.  In addition to certification of businesses under s. 370-25, the office of equity and inclusion shall certify any non-profit organization for participation in the small business enterprise program. 

 

Part 5. Section 370-27-4 of the code is created to read:

 

370-27.  Requirements for the Participation of Small Business Enterprises.
