Substitute resolution granting the City of Glendale permission to install a storm sewer system in North Range Line Road (North 27th Street) between West Good Hope Road and North Green Bay Avenue in the City of Milwaukee and approving and authorizing the Commissioner of Public Works to execute an agreement with the City of Glendale regarding ownership, maintenance and cost sharing of said facilities .

This substitute resolution grants permission to the City of Glendale to install a 12-inch, 15-inch, 18-inch and 27-inch storm sewer system within the City of Milwaukee in North Range Line Road (North 27th Street) from West Good Hope Road to North Green Bay Avenue in conjunction with the planned roadway improvements. The resolution also authorizes the Commissioner of Public Works to execute an agreement with the City of Glendale for the cost, maintenance and ownership of the sewer facilities on North Range Line Road (North 27th Street). The agreement establishes conditions under which the sewer can remain within the City of Milwaukee right-of-way.
BODY:
Whereas, The improvement of North Range Line Road (North 27th Street) between West Good Hope Road and North Range Line Road is included in the "Transportation Improvement Program for Southeastern Wisconsin: 1998-2000", and is eligible for 80% Federal cost participation; and
Whereas, The east one-half of North Range Line Road (North 27th Street) is in Glendale and the west one-half is in Milwaukee; and
Whereas, Resolution File Number 990932, adopted November 3, 1999, authorized the City of Glendale to act as the lead agent for the City of Milwaukee in the programming of the improvement of North Range Line Road (North 27th Street) between West Good Hope Road and North Green Bay Avenue; and
Whereas, The storm sewer system proposed by the City of Glendale extends up to six (6.0) feet into the City of Milwaukee; and
Whereas, The City of Glendale is seeking permission from the City of Milwaukee to install the storm sewer system within the City of Milwaukee street right-of-way; and
Whereas, It is proposed that the City of Milwaukee will be responsible for 50% of the local cost participation of the mainline storm sewer and the City of Glendale responsible for 50% of the local cost participation of the mainline storm sewer; and
Whereas, Both the City of Milwaukee and the City of Glendale will own and maintain respective sections of the storm sewer system and related mainline structures; and
Whereas, The City of Milwaukee and the City of Glendale property owners, adjacent to the proposed storm sewer will be permitted to connect their building services to the storm sewer with the proper permits; and
Whereas, Any existing or future connections will be approved by the City of Milwaukee and the City of Glendale, and no charges shall be assessed by either City for these connections to their respective storm sewer sections; and
Whereas, The installation of the storm sewer, combined with the City of Glendale's agreement on the conditions, is acceptable and will not impact future City of Milwaukee facilities in this area; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the City of Glendale is hereby given permission to install the 12-inch, 15-inch, 18-inch and 27-inch storm sewer system within the North Range Line Road (North 27th Street) right-of-way from West Good Hope Road to North Green Bay Road; at a location approximately 6 feet west of the right-of-way centerline; and, be it
Further Resolved, That said permission is subject to the agreement between the City of Milwaukee and City of Glendale for the ownership, maintenance and cost responsibilities of said storm sewer facilities in North Range Line Road (North 27th Street) between West Good Hope Road and North Green Bay Avenue; and, be it
Further Resolved, That the agreement with the City of Glendale which specifies ownership, maintenance and cost responsibilities of storm sewer facilities in North Range Line Road (North 27th Street) between West Good Hope Road and North Green Bay Road, a copy of which is attached to Common Council Resolution File Number 991463 and is incorporated in this resolution by reference as though set forth in full, is approved and the Commissioner of Public Works is hereby authorized to execute this agreement; and, be it
Further Resolved, That a certified copy of this resolution be forwarded to the City of Glendale.
