Title
Resolution authorizing the City of Milwaukee to enter into a federal funds subaward agreement with Harbor District, Inc. to accept and fund a sub-recipient grant from the National Fish and Wildlife Foundation for the installation of green infrastructure on South 1st Street from West Lincoln Avenue to South Chase Avenue as part of a City traffic safety and street repaving project, in the 12th and 14th Aldermanic Districts.
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division, to enter into a federal funds subaward agreement with Harbor District, Inc. to accept and fund a sub-recipient grant from the National Fish and Wildlife Foundation for the installation of green infrastructure on South 1st Street from West Lincoln Avenue to South Chase Avenue. The green infrastructure (“GI”), namely depaving, native landscaping, stormwater trees, and bioswales will be constructed as part of a traffic safety and street repaving project that will narrow and repave the existing roadway. Construction is expected to begin in 2025 and end in 2026. The City costs of the project approved by this resolution is $144,432.17 and the total estimated cost is $1,073,898.

Whereas, The Harbor District, Inc. (“HDI”) was awarded a 2023 Sustain Our Great Lakes (“SOGL”) grant in the amount not to exceed $528,385 (NFWF Grant ID 0501.23.079205) through the National Fish and Wildlife Foundation for the installation of GI along the Kinnickinnic River on South 1st Street from West Lincoln Avenue to South Chase Avenue, collectively known as “the Project,”; and
Whereas, HDI is working closely with the City of Milwaukee (“City”), City of Milwaukee Department of Public Works, Infrastructure Services Division (“DPW”), the Milwaukee Metropolitan Sewerage District (“MMSD”) and other partners (collectively known as the “Stakeholders”) to implement the Project, and
Whereas, The Project will take place within public right-of-way; and
Whereas, The City will be a sub-recipient of the SOGL grant from HDI and act as the fiscal agent for the construction of the Project; and
Whereas, The City will use its procurement authority to bid the project and the City will act as the lead project manager to implement the Project; and
Whereas, The total estimated cost of the project per the SOGL grant is $1,073,898, of which $545,513 is City share and the remainder is provided by said SOGL grant with a maximum reimbursement amount of $528,385; and
Whereas, A portion of the SOGL grant funding will be allocated to HDI to retain the Sigma Group, Inc. (“Sigma”) to perform the design services, engineering, complete construction documents, and assist during construction for the Project, in the amount of $88,507.00; and
Whereas, A portion of the SOGL grant funding will be allocated to the HDI for staff time and indirect costs in the amount of $66,363.13; and
Whereas, The City is responsible for paying for the construction services provided by the selected construction contractor and HDI will reimburse the City for construction costs in an amount not to exceed the $373,514.87; and
Whereas, The non-Federal match for the SOGL grant which is the City share of the project cost will come from MMSD Green Infrastructure Partnership Program (“GIPP”) grant and City capital funds; and
Whereas, The GIPP grant was authorized by Common Council File Number 231487 for a maximum reimbursement of $345,513; and
Whereas, $55,567.83 of City capital funds, authorized by Common Council File Number 241185 for Multi-modal transportation improvements at various locations, will be used for this project; and
Whereas, Additional capital funds are being requested per this resolution, the unused portion of said capital funds shall be returned to the parent account; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that DPW is authorized to enter into a federal funds subaward agreement with Harbor District, Inc. to accept and fund a sub-recipient grant from the National Fish and Wildlife Foundation in substantial conformance to the terms of the agreement attached to this file; and, be it
Further Resolved, that the Commission of Public Works, as a representative of the City of Milwaukee, is authorized to sign agreements, forms, claims and other required documents binding with the acceptance of the sub-recipient agreement; and be it
Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for these projects, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into contracts, subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
