Title

Resolution declaring four vacant lots surplus to municipal needs and authorizing their sale to Midtown Housing Corporation for residential construction, in the 4th Aldermanic District.

Analysis

This resolution will result in the sale of four vacant lots for new residential construction.

Body

Whereas, The Midtown Housing Corporation has submitted an Offer to Purchase the following vacant, tax-deed lots in the amount of $1 each:

2917 West Galena Street, 365-0782-110-8

 

1556 North 29th Street, 365-0778-120-3

 

1551-53 North 28th Street, 365-0751-5

 

1547-49 North 29th Street, 365-0752-0

 

; and

 

Whereas, The Department of City Development (“DCD”) recommends acceptance of said Offer contingent upon site and building plan approval by its Development Center and submission of a financial commitment to complete construction as proposed; and

 

Whereas, Said lots are to be sold in an “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; and

 

Whereas, A portion of several of said lots were previously sold to adjoining owners for use as green space and the deeds conveying the vacant lots contain restrictions that will not permit assemblage, division or new construction; and

 

Whereas, Removal of the deed restrictions is necessary to build housing on said lots; and

 

Whereas, The City Plan Commission has determined that there is no municipal need for said lots; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that said vacant lots are declared surplus, that the Offer to Purchase from Midtown Housing Corporation is accepted and that the Commissioner of DCD, or designee, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution; and, be it

 

Further Resolved, That the Commissioner of DCD, or designee, is authorized to prepare the proper documents releasing deed restrictions that will not permit assemblage, division or construction on said lots in order to facilitate redevelopment; and, be it

 

Further Resolved, That the proceeds from this sale be credited to the Reserve For Tax Deficit Fund Account No. 0001-334106.
