Title

Resolution authorizing the Department of City Development to issue an Exclusive Right to Negotiate for City-owned vacant lot properties in the 15th Aldermanic District.

Analysis

This resolution authorizes the Department of City Development to issue an Exclusive Right to Negotiate to Emem Group for the purchase of 40 scattered-site vacant lot properties within the 15th Aldermanic District for the purposes of allowing the Proposed Buyer to apply for financing and advance design development for the proposed development.

Body

Whereas, The City of Milwaukee (“City”) owns the vacant lot properties listed below (the “Properties”); and

 

Whereas, Section 304-49-3-b-3 of the Milwaukee Code of Ordinances (“MCO”) allows the City to sell, convey or lease neighborhood property which the department received direction from the local council member as to such property’s disposition pursuant to approval from the Common Council of the City of Milwaukee (“Common Council”); and

 

Whereas, Section 304-49-e of the MCO defines neighborhood property to include vacant residential lots suitable for one or 2 housing units acquired prior to March 24, 2024; and

 

Whereas, The Properties are vacant residential lots suitable for one or 2 housing units and were acquired prior to March 24, 2024; and

 

Whereas, The Department of City Development (“DCD”) continuously solicits and accepts competitive proposals from buyers and developers seeking to construct new homes on City owned land and this proposal was submitted through that process; and

 

Whereas, Emem Group (“Proposed Buyer”), or assignee, wishes to acquire the Properties to construct 40 new single-family homes on vacant lots in the Amani neighborhood; and

 

Whereas, The Properties proposed to be acquired by the Proposed Buyer for construction of new single-family homes are as follows:

Whereas, The Proposed Buyer’s financing for acquisition and development of the Properties involves Low Income Housing Tax Credits allocated by the Wisconsin Housing and Economic Development Authority (“WHEDA”) and the developer intends to sell the homes for affordable homeownership at the conclusion of the Tax Credit compliance period; and

 

Whereas, The Common Council’s approval is contingent upon Proposed Buyer obtaining DCD approval of final proposed home designs for Proposed Buyer’s development, securing all required financing to complete the project, and compliance with all other DCD and MCO requirements and securing all required approvals; and

 

Whereas, The Common Council’s approval of an Exclusive Right to Negotiate to Proposed Buyer will allow Proposed Buyer, or their DCD-approved assignee, time to finalize and submit their WHEDA application and to determine whether WHEDA will approve its application for a 2026 award of credits; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Exclusive Right to Negotiate is approved and DCD is authorized to issue to Proposed Buyer, or its DCD-approved assignee, an Exclusive Right to Negotiate for the properties listed above and substitute equivalent nearby lots for the ones listed above with the approval of the local Common Council member.
