Analysis
This substitute resolution authorizes and directs the Commissioner of Public Works and/or the City Engineer to negotiate and enter into a Right-of-Entry Agreement with the Southeast Wisconsin Professional Baseball Park District and the Milwaukee Brewers Baseball Club to allow construction on the portion of Canal Street within Miller Park in advance of execution of a Jurisdictional Transfer Agreement.
Body
 
Whereas, The City is currently performing design and right-of-way acquisition for the Canal Street Extension project; and
 
Whereas, A portion of the Canal Extension alignment was originally constructed by the Southeast Wisconsin Professional Baseball Park District in conjunction with construction of Miller Park and that portion is currently referred to as the Miller Park South Access Road (Frederick Miller Way); and
 
Whereas, The Commissioner of Public Works and the City Engineer are currently negotiating a Jurisdictional Transfer Agreement with the State of Wisconsin Department of Administration, the Southeast Wisconsin Professional Baseball Park District, the Milwaukee Brewers Baseball Club, Imperial Parking, and the Redevelopment Authority of the City of Milwaukee (RACM) to acquire the Miller Park South Access Road for public street purposes; and
 
Whereas, Full execution of the Jurisdictional Transfer Agreement is not anticipated until this summer; and
 
Whereas, The Canal Street Extension project is scheduled to be let to construction on March 8, 2005; and
 
Whereas, a Right-of-Entry Agreement with the Southeast Wisconsin Professional Baseball Park District and the Milwaukee Brewers Baseball Club is necessary to allow construction on the Miller Park South Access Road in advance of execution of the Jurisdictional Transfer Agreement; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and/or the City Engineer are authorized and directed to negotiate and enter into a Right-of-Entry Agreement with the Southeast Wisconsin Professional Baseball Park District and the Milwaukee Brewers Baseball Club, a draft copy of which is attached to Common Council Resolution File Number 041406 and is incorporated in this resolution by reference as though set forth in full, to allow construction on the Miller Park South Access Road in advance of execution of the Jurisdictional Transfer Agreement; and, be it
 
Further Resolved, That the authority hereby conferred upon the Commissioner of Public Works and/or City Engineer to negotiate the Right-of-Entry Agreement includes reasonable modifications that do not substantially change the intent of this resolution or nature of the transaction.
