Title

Resolution authorizing an easement with Milwaukee Metropolitan Sewerage District on City of Milwaukee property at 1225 South Carferry Drive, in the 14th Aldermanic District.

Analysis

This resolution authorizes an easement for the Milwaukee Metropolitan Sewerage District Combined Sewer Overflow 195 located on City-owned property at 1225 South Carferry Drive.

Body.

Whereas, Milwaukee Metropolitan Sewerage District (“MMSD”) is requesting a permanent access and infrastructure easement (“Easement”) on the City-owned property at 1225 South Carferry Drive (“Property”); and

 

Whereas, The Easement will document MMSD’s rights, as well as the location of its Combined Sewer Overflow 195 (“CSO 195”) existing on the Property; and

 

Whereas, On October 31, 2023, the Common Council adopted File Number 230854 authorizing the City of Milwaukee to approve the Milwaukee Estuary Dredged Material Management Facility (“DMMF”) Agreement with the Wisconsin Department of Natural Resources and MMSD for the Milwaukee Estuary Area of Concern (“AOC”); and

 

Whereas, CSO 195 was relocated in order to construct the DMMF on the east side of Jones Island in support of the Milwaukee Estuary AOC clean-up effort; and

 

Whereas, A portion of CSO 195 and its outfall is outside of public right-of- way; and

 

Whereas, A copy of the Easement, survey and related map is attached to this Common Council File; and

 

Whereas, MMSD agrees to a fee of $1.00; and

 

Whereas, Port Milwaukee and the City Attorney’s Office reviewed the proposed easement documents; and

 

Whereas, The City of Milwaukee Board of Harbor Commissioners approved the easement documents at its meeting on October 16, 2025; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the easement for Milwaukee Metropolitan Sewerage District Combined Sewer Overflow 195, in the form on file with the Common Council, is hereby approved and the proper City officers are hereby authorized and directed to execute and deliver the Easement Agreement on behalf of the City of Milwaukee; and, be it

 

Further Resolved, That the easement proceeds shall be deposited in the City’s General Fund.
