Resolution relating to the placement and maintenance of various pieces of sculpture in Catalano Square by Business Improvement District Number 2.
Analysis
This resolution grants permission to Business Improvement District Number 2 to install and maintain a space for sculpture on the City property known as Catalano Square in the Historic Third Ward. The site would be maintained at the district's expense and would be subject to removal upon the direction of the Commissioner of Public Works. The first sculpture on the site would be a work by BilHenry Walker.
Body
Whereas, Business Improvement District Number 2 (BID) wishes to install and maintain a place for sculpture on the City property known as Catalano Square; and
Whereas, The first sculpture to be installed on this site would be a piece by internationally-renowned sculptor BilHenry Walker - a piece recently juried into the prestigious "Convergence Art Festival" in Providence, R.I., for the 2003 - 2004 season; and
Whereas, The Catalano Square site could become a long-term location for sculpture sponsored by the BID and placed there on a rotating basis; and
Whereas, The BID wishes to construct a concrete pad approximately 8 feet in diameter to support these sculptures and the use of the public property for both the sculptures and the supporting structure requires the approval of the Common Council; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that BID Number 2 is granted permission to construct, in Catalano Square, a concrete pad approximately 8 feet in diameter generally in line with the center of North Broadway and to place thereon the sculpture depicted in the photograph attached to this file; and, be it
Further Resolved, That the BID may from time to time place other sculptures on the site, provided that permission is first received from the Commissioner of Public Works - such permission not to be unreasonably withheld; and, be it
Further Resolved, That the BID shall obtain all necessary City permits for construction of the concrete pad and installation of the sculpture and that the following shall be the conditions of these permits:
1. The BID shall maintain the initial sculpture and any subsequent sculptures at its own expense.
2. The BID shall hold the City of Milwaukee and its agents harmless and shall accept all responsibility for any and all liability that may arise through the implementation of the permission granted herein.
3. The BID shall remove at its own expense the sculpture and the concrete pad when so ordered to do so for reasons of public necessity and shall restore the site to its former condition in conformity with standards established by the Commissioner of Public Works.
