The Common Council adopted Resolution File Number 970223 on May 13, 1997 which authorized the Commissioner of Public Works to enter into an agreement with the Wisconsin Department of Transportation (WISDOT) for the programming and construction of three projects, known as the Jobs Corridor Projects. That resolution also directed the City Engineer to negotiate a Jurisdictional Transfer Agreement with the WISDOT for the transfer from State of Wisconsin control of several USH 41/45 local access frontage roads between West Florist Avenue and North 124th Street, to the City of Milwaukee. This resolution authorizes the Commissioner of Public to execute the Jurisdictional Transfer Agreement.
 
 
BODY:
Whereas, The City of Milwaukee Common Council Resolution File Number 970113, adopted May 13, 1997, directed the City Engineer to negotiate a Jurisdictional Transfer Agreement with the Wisconsin Department of Transportation (WISDOT) for the transfer from State of Wisconsin control of several USH 41/45 local access frontage roads between West Florist Avenue and North 124th Street, to the City of Milwaukee; and
 
Whereas, Section 84.02(8) of the Wisconsin Statutes enables the State to enter into jurisdictional transfer agreements with local units of government; and
 
Whereas, The jurisdictional transfers are part of a greater USH 41/45 Jobs Corridor Project, which includes roadway improvements in Milwaukee's northwest side and in the Village of Menomonee Falls; and
 
Whereas, The roads involved in the Jurisdictional Transfer Agreement are:
 
1.      West Fond du Lac Avenue (West Frontage Road).
 
2.      West Appleton Avenue (East Frontage Road/West Appleton Place/North 115th Street.)
 
3.      West Appleton Avenue/West Frontage Road/West Mill Road (North Frontage Road).
 
4.      West Appleton Avenue (East Frontage Road)/West Mill Road)
 
5.      The connecter road from West Mill Road Place to West Mill Road.
 
6.      West Mill Road (North Frontage Road)/North 114th Street
 
; and
 
Whereas, The WISDOT has submitted to the City of Milwaukee for execution an agreement which provides for the transfer of jurisdictional responsibility of the aforementioned roads; and
 
Whereas, This agreement stipulates this jurisdictional transfer does not become effective until November 15th of the year the WISDOT completes the Jobs Corridor Projects; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute an agreement with the WISDOT for the transfer of jurisdictional responsibility from the State of Wisconsin to the City of Milwaukee of the aforementioned roads, a copy of said agreement being attached to Common Council Resolution File Number 980836, and incorporated in the resolution by reference as though set forth in full.
