This resolution grants permission to the City of Wauwatosa to construct a storm sewer within City of Milwaukee limits.
 
 
BODY:
Whereas, On February 16, 1999, the Common Council of the City of Wauwatosa (Wauwatosa) adopted a resolution requesting from the City of Milwaukee (Milwaukee), permission to construct, own, operate and maintain a storm sewer in North 90th Street from a point 350'± south of West Center Street to West Center Street; and
 
Whereas, There is a storm sewer manhole in the southeast corner of the intersection of North 90th and West Center Streets in Milwaukee, said manhole being the junction point of 12 and 18-inch diameter storm sewers that were designed to carry storm water flows from the east and south; and
 
Whereas, Wauwatosa is requesting to connect the proposed storm sewer to the aforementioned storm sewer manhole with said 18-inch diameter storm sewer as an outlet; and
 
Whereas, Said 18-inch diameter storm sewer has sufficient hydraulic capacity to carry additional street surface flows only from that portion of North 90th Street within Wauwatosa limits; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the City of Wauwatosa is hereby given permission to construct a storm sewer within Milwaukee limits in North 90th Street from the City limits line to the storm sewer manhole described herein above under the following terms and conditions:
 
1.      The proposed storm sewer shall be used for street surface drainage purposes only.
 
2.      No house storm sewers shall be connected to the proposed storm sewer.
 
3.      Should it be decided, at a future date, that house storm sewer connections are needed, Wauwatosa shall agree to replace said 18-inch diameter storm sewer with a storm sewer of sufficient size and elevation at Wauwatosa's own expense. However, if it is determined at said future date that the 18-inch diameter storm sewer was in poor structural condition, the City of Milwaukee shall replace said sewer at its own expense.
 
4.      The proposed storm sewer shall be constructed at the expense of Wauwatosa.
 
5.      The final location and alignment of said storm sewer shall be determined upon submittal of field survey notes by Wauwatosa to the Commissioner of Public Works of the City of Milwaukee for review and approval.
 
6.      Said storm sewer shall be constructed at a sufficient size and elevation.
 
7.      Wauwatosa shall submit the sewer design computations and three (3) sets of sewer plans to the Commissioner of Public Works for approval prior to construction of the storm sewer.
 
8.      Wauwatosa shall cause its contractor to obtain an excavating permit from the Department of Public Works prior to commencing work within City of Milwaukee limits.
 
9.      Backfilling and trench surfacing within the limits of Milwaukee shall comply with the specifications of the Department of Public Works of the City of Milwaukee.
 
10.      Wauwatosa shall notify Field Operations of the Infrastructure Services Division at (414)286-3427 three (3) days prior to connecting the proposed storm sewer to Milwaukee's storm manhole.
 
11.      Wauwatosa shall provide Milwaukee with an as-built plan of the storm sewer within Milwaukee limits.
 
12.      Said storm sewer shall be owned and maintained by Wauwatosa to the point of connection in Milwaukee.

Further Resolved, That a certified copy of this resolution be forwarded to the City of Wauwatosa.
