Analysis
This ordinance creates a pilot street-sweeping program, which establishes fixed monthly street sweeping days for designated streets within the 3rd and 14th aldermanic districts. Under this program, which shall be in effect from passage of this section (city clerk to insert date) through November 30, 2002, parking on the designated streets within the pilot area between the hours of 8 a.m. and 3 p.m. on the day the street sweeping shall occur is prohibited.  In addition, in order to maximize the effectiveness and efficiency of the street sweeping program, this ordinance provides for the ticketing and towing of motor vehicles parked not in compliance with the parking restrictions to be in effect on the designated street sweeping days.  Pursuant to s. 101-34-2-d, the forfeiture for citations for parking on the designated streets during the restricted hours on street sweeping days shall be $30.

Whereas, Various residential areas of the city experience a high demand for on-street parking which restricts accessibility to the curb line for effective street sweeping operations; and
 
Whereas, Establishing fixed monthly street sweeping days for certain residential streets where parked vehicles restrict accessibility to the curb line will increase the effectiveness and efficiency of street sweeping operations; and
 
Whereas, Strictly enforcing the parking restrictions, which are in effect on the designated street sweeping days, through both ticketing and towing, will reinforce compliance; and
 
Whereas, The long-term benefits realized by a more efficient delivery of street sweeping services and a more effective street sweeping operation will offset the resources expended to create this pilot street-sweeping program; now, therefore
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 101-25-1 of the code is amended to read:
 
101-25.  Towing Away of Vehicles.
 
1.  AUTHORITY.  Whenever any police officer, or the commissioner of public works or any of the commissioner's designees finds a vehicle standing upon any highway in violation of ss. 101-3, 101-22.5, 101-23, 101-24, 101-24.1, 101-24.2, 101-26, 101-26.5,>>101-26.7,<< 101-27 and 101-32, the officer, or commissioner of public works or the commissioner's designee is authorized to remove the vehicle to either private or public parking or storage premises.  The removal may be performed by or under the direction of the officer, or the commissioner of public works or the commissioner's designee, or a towing contractor under contract with the city.  The vehicle reclamation charge that is imposed in order to reclaim a vehicle under this section shall be $95 per vehicle and $20 for each day of storage.  The vehicle reclamation charge shall be paid to the commissioner of public works at the storage facility and the vehicle may be released from storage upon payment of all vehicle reclamation charges and presentation of proper identification.  A notice informing the owner of the location of the vehicle, the procedure for reclaiming the vehicle and the availability of a review before the city attorney shall be mailed to the last known address within 24 hours after removal.
 
Part 2.  Section 101-26.7 of the code is created to read:
 
101-26.7.  Street Sweeping Program.  
 
1.  PURPOSE.  The common council finds that various residential areas of the city experience high demand for on-street parking which restricts the accessibility of street sweeping brooms to the curb line for effective street sweeping operations.  The common council further finds that, in order to increase the effectiveness and efficiency of street sweeping operations, it is necessary to designate certain residential streets in the city as street sweeping streets and to prohibit on-street parking during certain hours on such streets on the day the street sweeping shall occur.
 
2.  DESIGNATED STREET SWEEPING STREETS.  a.  First Wednesday of the Month.  On each of the following streets between the hours of 8 a.m. and 3 p.m., there shall be no stopping or standing of motor vehicles on the first Wednesday of each month from passage of this section, April 23, 2002 through November 30:
 
a-1.  The east side of the 2900 through the 3400 blocks of North Cambridge Avenue and North Bartlett Avenue.
 
a-2. The east side of the 2800 through the 3200 blocks and the 3400 block of North Cramer Avenue.
 
a-3.  The east side of the 2800 through the 3000 blocks of North Frederick Avenue.
 
a-4.  The west side of the 2900 through the 3400 blocks of North Newhall Street.
 
a-5.  The west side of the 3000 through the 3400 blocks of North Oakland Avenue.
 
a-6.  The west side of the 2800 through the 3000 blocks of North Murray Avenue.
 
a-7.  The north side of the 1500 through the 1800 blocks of East Newport Avenue.
 
a-8.  The north side of the 1500 through the 1700 blocks of East Hampshire Street.
 
a-9.  The north side of the 1500 through the 2100 blocks of East Linnwood Avenue.
 
a-10.  The north side of the 1800 through the 2100 blocks of East Newberry Boulevard.
 
a-11. The south side of the 1500 through the 1700 blocks of East Providence Avenue.

b.  Third Wednesday of the Month.  On each of the following streets between the hours of 8 a.m. and 3 p.m., there shall be no stopping or standing of motor vehicles on the third Wednesday of each month from the passage of this section, April 23, 2002 through November 30:
 
b-1. The east side of the 2900 through the 3400 blocks of North Newhall Street.
b-2. The east side of the 3000 through the 3400 blocks of North Oakland Avenue.
 
b-3.   The east side of the 2800 through the 3000 blocks of North Murray Avenue.

3.  EXCEPTIONS.  a. This section shall not apply to any of the following:
 
a-1.  An emergency vehicle, including but not limited to an ambulance, fire department vehicle or police department vehicle.
 
a-2.  Any vehicle, including but not limited to a delivery, utility or service vehicle, which is being used by a person engaged in the provision of services or delivery of goods to a property located on the designated street, provided the name of the commercial enterprise or public utility vehicle providing the service or delivering the goods is clearly identified on the vehicle.
 
Part 3.  Section 101-34-2-d of the code is amended to read:
 
101-34.  Stipulation Procedure; Nonmoving Traffic Violations.
 
2.  FORFEITURE SCHEDULE.
 
d.  Citations issued for violations of ss. 101-26.5>>, 101-26.7<< and 101-27-4: $30.
 
Part 4.  This ordinance shall be null and void after November 30, 2002.
