Analysis

This resolution authorizes the proper City Officers to accept Sewer Easement SE-2893 and execute Quit Claim Deeds, QCD-2894 and QCD-2948 conveying combined and storm sewers to MALO WI, LLC, in the 15^th Aldermanic District. These sewers and sewer apparatus are being conveyed because they are no longer needed for public use.

Body

Whereas, the public right-of -way vacation was requested by MALO WI, LLC for their benefit; and

Whereas, the land owner is willing to grant Sewer Easement SE-2893, which will include combined sewers and also give the City permission to enter the property, and to construct, operate, maintain, inspect, and repair all sewer facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement document that has been made part of this file; and

Whereas, the City of Milwaukee owns storm and combined sewers in vacated North 32^nd Street from a point 494± feet north of the southern line of Lot 1 of Certified Survey Map (CSM), 9186 south to a point 3± feet south of the southern line of Lot 1 of Certified Survey Map (CSM), 9186  ; and

Whereas, the City of Milwaukee owns a combined sewers in vacated West Clarke Street from a point 12± feet east of the eastern line of North 33^rd Street east to a point 259± feet east of the eastern line of North 33^rd Street; and

Whereas, The said sewers to be conveyed no longer serves the public interest; and

Whereas, MALO WI, LLC has agreed to accept ownership of said sewer, and therefore be it further

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized to sign Sewer Easement SE-2893 and execute the Quit Claim Deeds documents (QCD-2894 and QCD-2948) in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution) and to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
