Resolution authorizing the Commissioner of Public Works to accept a developer deposit covering the cost of design engineering for a potential street vacation at the southeast corner of West Kilbourn and North Plankinton Avenues and to issue permits for improvements related to the potential vacation in advance of a formal decision to vacate. - ANALYSIS - This resolution authorizes the Commissioner of Public Works to accept design engineering funds from and issue applicable permits to a restaurant developer. These actions would expedite the restaurant project allowing work to proceed in advance of an actual decision to vacate a portion of the West Kilbourn Avenue/North Plankinton Avenue intersection. All work done in advance of a formal decision to vacate would be at the developer's risk.
 
 
BODY:
Whereas, Central Investment Company has proposed development of a restaurant along the Milwaukee River at the southeast corner of the North Plankinton Avenue/West Kilbourn Avenue intersection; and
 
Whereas, Plans for the restaurant call for creation of a valet parking drive-through lane off of North Plankinton Avenue; and
 
Whereas, The valet parking drive-through lane will necessitate the vacation of an existing right turn by- pass lane adjacent to the restaurant site; and
 
Whereas, The developer has initiated the street vacation process by filing a formal application with the Department of City Development; and
 
Whereas, The vacation process usually takes four to six months thereby prohibiting construction of necessary changes in the street configuration during the 1997 construction season; and
 
Whereas, A construction delay until 1998 could jeopardize the project; and
 
Whereas, The developer has requested permission to proceed with the necessary work in advance of a formal decision by the City to vacate the street segment in question; and
 
Whereas, The developer is willing to deposit funds for design engineering, to assume all costs associated with the vacation-related improvements, and to restore the street to its original condition at his sole expense should the vacation ultimately not be approved; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to accept deposit funds from Central Investment Company for the purpose of preparing engineering plans and specifications for the potential vacation of the right turn by-pass located at the southeast corner of the North Plankinton Avenue/West Kilbourn Avenue intersection; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to issue permits for paving and landscaping work that would be associated with the proposed street vacation upon submittal to the City by the developer of a signed vacation petition for the street segment in question; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to accept deposit funds from the developer to cover the cost of any work related to the potential vacation that would be performed by City forces; and, be it
 
Further Resolved, That the Commissioner of Public Works, prior to the issuance of the permits referenced above, shall determine the cost of restoring the intersection to its current condition and shall accept from the developer a letter-of-credit in such amount to be drawn upon only in the event the Common Council does not approve the street vacation.
