Resolution relating to acceptance and funding of a Green Solutions grant from MMSD for the installation of bioswales in the parking lanes of North 17th Street between West Highland Boulevard and West Walnut Street and on the north side of West Cherry Street at its intersection with North 26th Street as part of the City’s Safe Routes to Parks program and authorizing entry into a post installation Maintenance Covenant with MMSD, in the 4th and 15th Aldermanic Districts.

Analysis

This resolution authorizes the Department of Public Works, Infrastructure Services Division, to accept a Milwaukee Metropolitan Sewerage District Green Solutions grant funding for the construction of bioswales with a maximum reimbursement amount of $270,000. The bioswales will be constructed in the parking lanes of North 17th Street between West Highland Boulevard and West Walnut Street and in the terrace areas of the north side of West Cherry Street at its intersection with North 26th Street. The bioswales will be constructed as part of the City’s Safe Routes to Parks program. The resolution also authorizes the Commissioner of Public Works to execute a post installation Maintenance Covenant with the Milwaukee Metropolitan Sewerage District.

Body

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and

 

Whereas, Green infrastructure reduces the volume of stormwater in the sewer system and the amount of pollutants discharged to surface waters; and

 

Whereas, As part of Safe Routes to Parks program, the City proposes concrete traffic islands as traffic calming measures on North 17th Street around King Park and traffic calming bumpout on West Cherry Street at North 26th Street around Tiefenthaler Park; and

 

Whereas, The City desires to add bioswales as Green Infrastructure to complement the areas where said traffic calming measures are located; and

 

Whereas, The bioswales provide water quality benefit in compliance with the City’s stormwater discharge permit with the Department of Natural Resources (DNR); and

 

Whereas, MMSD desires to promote the installation of green infrastructure practices such as bioswales and is willing to provide the City funding as part of its Green Solutions Program; and

 

Whereas, A template Maintenance Covenant to be used post-installation is submitted to this file; now, therefore, be it

 

Resolved, That the Commissioner of Public Works is authorized to accept MMSD Green Solutions Funding in accordance with Milwaukee Code of Ordinances 304-81; and, be it

 

Further Resolved, That the Green Solutions funding agreement (G98005P180) and the template maintenance covenant submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City thereunder so as to carry out the intent and purpose of this resolution and those documents; and, be it

 

Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
